Good day! I badly needed help... I am hoping anyone could at least help us out regarding my situation. I had my interview at US Embassy, Manila last July 28, 2016. Due to some unintentional matter,  I got denied. I was then given a letter right after my interview stating the caused why i got denied.

212(a)(6)(C)(I)  -  You sought to procure, or have procured, a visa or entry into the United States by fraud or by the willful misrepresentation of a material fact.

Further explanation said that since my case didn't fall for those other ineligibilities, I can apply for a waiver. It is also stated that my petition will be returned to the USCIS through NVC for reconsideration and disposition.

My problem now is that, We've been calling USCIS before and they said that my petition papers are  not back yet to USCIS even at the NVC. They cant give us further instructions regarding the filling of the waiver if my petition papers are not sent back there. They said that i should call the US Embassy Manila about it. Me and my fiance have been calling the US Embassy Manila for SO MANY TIMES but the Customer service cant give us the information we wanted. They keep telling us to wait for it, but it is almost a year now and still we never get anything back from US Embassy Manila regarding the status of my paper if it is forwarded already or not. We are losing hope here. Can anyone tell us how long would it take for them to send it back? What shall we do?  PLease..Please..I am begging anyone here who could help us out. Thank you and God bless Everyone...

When it comes to government timelines, no one can tell you with any certainty that you will receive, it will be sent, it will leave someones desk or it will arrive etc. I know your are frustrated I get that. But you have to keep trying. Here are some other ways of approaching this.

*Email the Ombudsman at cisombudsman@HQ.DHS.GOV

The Ombudsman provides an impartial and independent perspective to USCIS in an attempt to resolve problems.

Contact the Embassy (Manila) Manila Visa Information and Appointment Service center hotlines at (632) 976-8500, (632) 976-8501 or (632) 976-8502. The center is open Monday through Friday, from 8:00 a.m. to 8:00 p.m. (Manila time), except on Philippine and U.S. holidays. Callers in the U.S should call (703) 520-2235 on its Eastern Standard Time equivalent of operation hours.

Skype: To use Skype to speak to a customer service representative Monday Friday from 8:00am to 8:00pm., please add a new contact to your Skype account with the Skype name ustraveldocs-philippines.

Congress woman or gentleman for his district.

And, I am sure you have read up on this infraction and the process for requesting a waiver but I will put a link here https://www.uscis.gov/policymanual/HTML/PolicyManual-Volume9-PartG.html

Good luck.

The denial states you procured or try to procure a visa by fraud or willful misrepresentation...

Fraud isn't anything easily waived.

This section states very limited circumstances that a waiver would be granted.

Hi sorry to say but your in a bad situation because of the fraud flag that the Embassy put on your file I wish that you would explain why to us so we can help you more , calling the Embassy is worthless if you can have an immigration attorney inquire on your behalf that would help a lot

What was the fraud?

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”
