HELLO EVERYONE,

My husband and i are about to go through the process for my adjsment status for me to get a green card and a working permit. i would like to know what are the different forms that i need to fill, wich document to attach to each form and how to send them.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Are you adjusting from a certain type of visa?

If it's K-1; fill out the I-485 form (adjustment of status), I-765 and I-131 (employment authorization and advance parole). Write a complete check of $1225, that is including the biometrics fee. You don't have to pay for the work permit, the fee is waived when filling with I-485.

Visitors visa; I-130 (spousal), I-485, I-765 and I-131. Total check of $1760

01/13/2016: I-129F filed  07/15/2016: K-1 visa in hand
10/13/2016: Filed AOS + EAD/AP.   07/07/2017: Permanent resident (Conditional)
04/16/2019: Filed ROC  11/17/2020: Approved. (10 yr GC)

 

Naturalization                                                        
09/02/2020: Filed (Online)    09/08/2020: NOA1: (NBC
10/22/2020: Biometrics Reuse Notice.  12/22/2020: Online Status Changed to Interview Was Scheduled.  
01/29/2021: N-400 Interview - PASSED! 01/29/2021: Same-day oath ceremony.

Than you dutchster, but i precise that i'm already in the united states. unfortunately with an overstayed visitor visa.

Then you will adjust from the visitors visa.. as long as you entered legally, the overstay will not be held against you, as spouse of a USC. At the moment though you have no legal status...so you risk deportation.. 

Once you file the AOS forms, you will be allowed to stay while the case is being decided... you can work legally when you receive the EAD card about 4 ,months after filing.. the reat of the process will taks 12 months or so... 

The quicker you are at filing, the sooner you will be safe and not at risk of deportation at this time.
