we need more information

His son is 7 and he was 5 when we got married and yes we did list him on his K1 application as well as the adjustment of status.

when did your husband receive his K1? if it was within a year, he can come on a K2 and adjust status in the US like your husband

 

if it has been more than a year, you will have to file the i130 for him

 

will his mom authorize him to leave the country?

Yes it has been over a year since he can on the K-1 his mother is completely fine with him migrating we all have a good relationship. I know I have to do the I-130 but as his step mother can I petition for him?
