We did recive our RFE in a unusual way ( see other posts)

In it was a request for a translation of the birth certificate.

What I did sent in was a Dutch certified one one and a certified copy of the international one, approved by the counsil of Vienna.

In the international one, it has 7 languages, like in may passports, including English.

According to the MSC, this ain't good.

The English version is not the first language appearing, you need to read!!!!

I took this to my Infopass appointment this week and showed the lady and she didn't understand, why it was rejected, because she said it was obvious there was English on it.

She said for her it seems to be enough,but maybe they want a full English translation.

To make it easier for them.

After them already sending my letter to some one else and not being able to read an international document, I am wondering if they ever need any education to work there.

What do we do next. It hard to find a translator here, who does Dutch/English. Spanish wouln't be a problem, they are all over.

And the infopass lady said, what we have is enough, but then the MSC still wants something else? What do mean they are confusing? They don't even know what they really want.

Anyone having experience with that? What did you do?

Ok, but you don't have to translate anything because you have it in english already, so I dont know if this is legal or not, but **I** would just copy the english version into a new sheet (typed, of course) and then have someone sign the bottom of it saying they speak both languages (english/dutch) - that's all you will need.

You are not asking someone to forge or fake any information from your birth certificate, so I don't see a problem. My wife translated her birth certificate and we just had a friend sign it. I am sure it is not the right procedure, but if you want you can spend all your time trying to find someone who speaks dutch meanwhile your process will be seriously delayed.

Did you get the name and time of the infopass where she said that that should be enough for the english translation? If so I would send it back, along with a letter stating that you had an infopass (reinforcing the fact that they sent your info to the wrong peeps originally ) and mention the name and time and what the lady had said that this would suffice. But, maybe to ease your mind you could also get it translated just to english and send that along as well, that was it is translated twice. But, don't really know if that is necessary. Good luck.

Maybe they are referring to the Dutch only one in the RFE even though you sent them an international one with 7 languages including English. Maybe resend copies of both together with post it notes indicating the English on it.

I agree with the above post. A lot of times RFEs come for things already sent. So I'd just send the copy again, with an extra copy with the English translation highlighted and an attachment stating that it was approved by the counsul, etc.

As far as I know, is that, if they don't approve the RFE, they will deny your case. No second RFE's.

You need to send them what they asked for, or your case won't continue processing. I've heard of quite a few international birth certificates not being accepted - if you have to retype what's on there and have someone (is your husband fluent in both? have him do it - we translated our own and no RFE) who is fluent sign it, do it.

Making excuses for why you don't need to send it won't work. According to a former adjucator, when that RFE gets sent back in, if it's not what that employee who initally reviewed it as for, it probably won't make it because they're the person who reviews the RFE response as well.
