Good Morning,

I've been reading the posts on this site, as a Guest and today I became a member. I need some help...Please. I'm having this sense of worry. I don't know if I qualify for the income portion of the affidavit. Based on my W-2's it shows to different amounts. One says "Gross Pay" and the other says " Wages,Tips, other Comp" ( Line 1. of my W-2's) The difference between the 2 is a little over $2,000.00 dollars. Based on the 2017 HHS poverty Guidelines- 2 persons Fiancé Visa is $16,240 and the Marriage Visa is $20,300. My Gross pay for 2016 was $21,967 but under Wages,Tips, Other Comp. it says $19,872 (With taxes, Insurance, additional life insurance taken out for the year of $2,095) My Question is did I make enough? Do we need a sponsor? Additional info: I have a sizeable life Ins. policy, I own several vehiecles (No payments) I own, my own home and 5 Acres of land ( No Payments- I have the Deed) I have a little over $10,000 in savings, and several Credit Cards with spending limits of 10 thousand+ (no Balances), and other assets. In advance, I'd like to Thank you for your help.

It's not based off your W2, it's based off your tax return. The amount you make is the Adjusted Gross Income line, which would basically add up all your income. If you filed Form 1040, theAGI is on line 37. * If you filed Form 1040A, the AGI is on line 21. * If you filed Form 1040EZ, the AGI is on line 4.

Have your filed your taxes? If not, you'll need to do it as having a W2 without a tax return is not enough.


Also note, while they CAN use the 100% of the poverty line, they can also choose to use the 125% of the poverty line as well. It's up to their discretion, it's always best to plan to make more than the 125% line to be on the safe side.

Thank you for your quick response!  I have come across 3 sets of what the income requirement guidelines are??? One says Fiancé Visa- $16,240 and Marriage Visa- $20,300. Do you happen to know, what the income requirement is? and do I need to follow the 100% one or the 125% one? If I follow the Fiancé one- I got it! But if I follow the Marriage one- I fall short by $427 dollars!!! So I guess, we"ll need a sponsor??? My Taxes are done. and for 2015 I met the requirement. I didn't work for 5 weeks last year ( I was doing some traveling and that put me under, I guess)

What I've read here before, and I'm just quoting, is that for any amount you lack vis-a-vis making the income requirement, you must have three times that amount in the bank. For instance, if you only are 200 under the minimum, you must have over 600 in the bank. So since you have 10,000 and are 427 under (worse case scenario), you should easily make it. But again I'm just quoting by memory what I've seen here before.

Im not trying to hi-jack the thread, but I have  the same concerns. Im on SSDI, which doesnt show squat for earned income, but on my I-134, I do show household value of 73k (paid in full) and no other debt listed. Im asked my parents to co-sponsor my fiance, and they are on SSI also, but have other stocks, bonds, property to account for. 

 

DO they use my SSDI statement to calculate the % of poverty level, or some other means?

 

ANy help is greatly appreciated!
