If it is his to cash out at any age, with no penalty, then it could be an asset. But some things incur penalties for early withdrawal.

It's taxable if he withdraws it before 60..but do me it's still an asset? What do you think?

The official word from the USCIS is

 

Only assets that can be converted into cash within one year and without considerable hardship or financial loss to the owner may be included. The owner of the asset must include a description of the asset, proof of ownership, and the basis for the owner’s claim of its net cash value .

 

You decide. I don't really know what would satisfy the officer on interview day.  You can take proof and if they throw it out, then you know.

Thanks! How do you Find all this info!! I googled and find only vague stuff. Wouldn't it be considered before interview or Ann I missing something (I'm a newbie!) and is that something they'd ask at my interview or his? Id be so worried to get to interview and have a possibility of it being turned down on something like that..this whole process makes me very nervous lol

I read the official word on the form instructions, the USCIS website, and the London embassy website. not forums. And I have done a lot of form instructions getting from K1 to US citizenship. 

 

So for starters, read your first form and instructions,  I-129F, Petition for Alien Fiancé(e)

and get it only on USCIS.gov to make sure you have the latest version.

 

If they wanted financial information, it would say so in the instructions.

If using assets, you can refer to the NVC FAQs - Use of Assets to Meet Income Requirements section which has quite a bit of information.  It has to be cash convertible within one year.
