Yes we are! Just got our NOA2 dated June 3rd :D Now we're just waiting for our case file to be assigned a case number and transferred to my local embassy for an interview.

I'm the foreign beneficiary but I actually compiled and did all the paperwork while my fiancé only signed where needed :jest: 

 

We are quite lucky that the time taken between our NOA1 and NOA2 was a little shorter than the current processing experienced by our fellow filers from the same period. To be more realistic, it usually takes approximately 3 months to receive a NOA2, longer if the adjudicator is slow, backlogged or there are further checkings needed.

 

What you can do is make sure you have all the required forms, required documents, current fee and other supporting documentation that you'd like to add to support your petition. Organise it the best you could. Also, when you mail your petition, use a reliable and trackable mail service for your peace of mind.

There has been discussion on this website in the U.K. forum before. There is no published figure. The ones I remember had $40-50k in savings. They took proof of their savings to show.  One had a contract on his house, but it hadn't actually sold yet. He took the contract and documentation of what he still owed on the mortgage to show how much he would receive from the sale.

Self sponsorship needs to be a significant amount of savings for London to accept it with plenty of documented proof. There was one recent case of it not being accepted. I cannot say why but may have been due to a variety of factors like a newbie caseworker, not enough evidence etc. Make sure to have a backup just in case.

I saw that one and I think the interviewer was mixed up because said  beneficiary needed an  I-864 from a joint sponsor, which isn't K1 form. If new officer was thinking it was same rules as spouse visa, then self-sponsorship wouldn't be allowed per the law requiring US domicile to sponsor. If the beneficiary would have understood it more clearly, he probably could have straightened it out while there at the interview.

It seems a bit hit or miss? Seems quite poor to me that the official wouldn't be aware of what's needed? That does make me slightly wary about self sponsoring...I have a house with equity and savings so I can prove I am able to support myself comfortably in the States but I'd be nervous if the person who interviewed didn't know much about self sponsoring...

Yep I think I would use my finances as a back up rather than then self sponsoring. Thanks for the help

You are really on top of your game! If we don't use a lawyer I would do the same as you as my fiancé is more of a creative person and a paperwork person lol😂😂 thanks for the

advice..I have a checklist to start gathering all the documents needed :)

Thank you for the compliments :) I'm sure you'll be able to submit a complete and well supported petition like we did. Having a checklist helped me tremendously at the compilation stage to ensure I didn't miss anything out. Good thinking!!

That is the first person I have ever seen post that was denied self-sponsoring.  Officers are human and not all as perfect as we want them to be. I could see how he just didn't have his head focused on  business and in his mind he got off on the spouse track over fiancé.

 

 But as far as the law goes, it is quite specific on an I-864 (used for spouse visas and adjustment of status to get a greencard). The spouse must fill out a form even if not enough income, a tax return must be submitted, a joint sponsor must be a US person, and 125% of the poverty level is required.

 

There is nothing written in the law concerning fiancé affidavits of support other than the officer must be convinced that the beneficiary will not become a public charge.  So London has been convinced in the past with the things I mentioned before: self sponsoring; another person sponsoring, with no forms from the fiancé; 100% of the poverty level; proof of income other than a tax return. It's a subjective decision so your job is to be convincing.  If your fiancé falls short, but you can show some income and savings from him plus savings of your own, then it's possible. But you have to realize after the marriage, there is the whole greencard process that will require more specific things.  And perhaps your fiancé will have another tax return in by then (2017) and he won't take so many business deductions and will show enough profit on the return to meet the income level. There is also a formula for using assets to make up a shortfall on income. If you are $5,000 short, then $15,000 in assets.

Assets needed = 3 X [shortfall in income].

Ok thank you :) that helps to know. Do you know if a pension can count towards the amount as evidence? It's more money for him if it does. I spoke to a lawyer today who tried to talk me out of self sponsoring 🙄

 Pensions count if you are receiving a monthly pension check. Is he retired?
