I wanted ask a question about CR visa. I read something about when you re married less than 2 years. They give a greencard temporary, then after 2 years u can get finnally the definitive greencard. Other thing, if me married with my wife since almost 2 years. It can be completed after our interview in my embassy in Brazil then after the final approval. I can wait more time, supposing more 2 month something to wait, till the 2 years of marriage are completed then i back to USA, once when i entry of port board, they give me a stamp of official definitive green card ready? Its possible? Sorry my english is weird hehehe but i am studying hard to get better.

I think you understand.

If you have been married LESS than two years when you enter the US the first time (with a CR/IR visa), your status will be conditional, your Green Card will be valid for two years and you will need to file one more form.

If you have been married MORE than two years when you enter the US the first time(with a CR/IR visa), your status will not be conditional, and your Green Card will be valid for ten years.

Yes you have your facts correct, if you wait until after 2nd wedding anniversary to enter the USA, make the officer at the POE aware of that fact, and he will code you for the permanent unconditional green-card, and treat your visa as a IR-1 visa.

YuAndDan and meauxna, thank you very much. Now i have another question. What the difference would be beetween permanent unconditional and permanent conditional greencard ? well i know, that first option is for after 2 years of marriage and having a official greencard of 10 years to renew while second option is for after my entry i got 2 years conditional to make neecessary renew to unconditional definitive greencard.

But what is really difference for you? Just having confort to dont stress till 10 years later or what.

If you had a chance to wait till complete 2 years of marriage you should wait or entry in US before it? Whats your preference?

Damn my english... hope you guys understand me. :o

The primary thing is that they are looking for a bona fied marriage, not a sham marriage, USCIS considers a couple who have been living together in a genuine marriage arrangement to be long enough to be legit, so issues the unconditional LPR status. Remering the 10 year card is just the process of filing a I-90. But the conditional one requires that the conditions are lifted and some proof of legit marriage be shown to lift the conditions.

Aside from having to go through removal of conditions near the two year mark after point of entry, there isn't a difference between the two-year and ten-year card. If it meant only delaying by a couple months, then yes it would be worth it for the money and hassle saved. But if it meant a delay of more than a couple months, I wouldn't wait personally. Obviously everyone has different personal circumstances.

US Immigration Timeline

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

Read the links in my signature, the first two Now That You Are A Permanent Resident & How Do I Remove The Conditions On Permanent Residence Based On Marriage? explain exactly what you are asking--what are the 'differences' between a regular PR and a PR with conditions.

(hint: there is NO difference, other than conditional residents MUST file I-751 in two years).

For some people, it is worth waiting until after the 2nd wedding anniversary. You will save the hassle of filing I-751 and the $$$.

On the other hand, it is no hassle, really, to file I-751. I would have like to spend the money on shoes, but you know how it is. Maybe it is more important to you to come to the US as soon as you can. There is no one right answer. AND, if the VISA you get is before your anniversary, it will be CR-1. It will be up to YOU to make sure that the officer correctly enters you as IR-1 at the POE. At least once before, this did not work correctly and the person had to file I-751 anyway. So, it is up to you, but I don't know if it is worth missing more days together--you and your spouse can decide.
