Did not include interpreters and prepares pages

Hey there,

 

So we filled my I-130 and I-130a form and we decided to not include the interpreters page and prepares page. Considering we did not use an interpreters or prepare. I am worried now if that will cause an issue. Does anyone have an insight on this matter. If so how is there a way to rectify it?

You might not have used an interpreter and preparer but you've gotta submit all the pages of each form. I-130 has 12 pages before continuation sheets so you'll need to send in all 12 pages. You cannot omit any of them. If you leave them out, the adjudicator might think you've submitted incomplete forms and that might result in a RFE.

Is it to late to get it in now. My application was sent in and I got the NOA 1 in late may,

Right now you can't send in anything new, additional or replacement. You can only respond to a RFE if they ended up sending you one

Yes; trying to send it at this point is likely to be nothing more than an exercise in futility as it is highly unlikely that it would be matched with the file.

 

There are 3 possible outcomes ranging from most likely to least likely:

• You will receive an RFE for the missing page.
• An adjudicator may decide to overlook it since it's the interpreter page.
• The petition will be denied outright based on an improperly submitted form.

If the reject my application. Is there a time frame I have to wait to reapply?

Let's dispatch with the semantics first, the I-130 is a petition form, not an application form (you are not applying for anything, you are petitioning).

 

In the event of a denial on this basis, you can refile right away; there is not timeframe you would need to wait.
