Hello people

Please help me know how long it will take for the USCIS finished reviewing our document which been denied under section 221g that our married is a sharme or fraud as the embassy said it. They just received it and said they are working on it and will let us know when they finished by mailing us. And what types of documents they may have need if necessary for confirmation that our marriage is not fraud at all . please I need your help thanks !!!

Very sorry to hear this. If you had your interview in Ghana that is a very high fraud Embassy application centre. Seems like the application will be sent to USCIS as you say and a NOIR or NOID will be sent to your fiance (Notice of Intention to Revoke or Deny).

 

How long were you both dating and how many times did your USC fiance visit you? Is there an age difference between the two of you? What is your Occupation?

It can vary widely, I have seen anything from 4 months to years.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Agreed. I would hope for six months but realistically you're probably looking at a year or longer.

We are married since December 2015 and she visited Ghana two times from now. She is 43 and I am 48. I am a Fanshion designer by profession

This is what the USCIS said : On June 13, 2017, the Department of State sent us your case, Receipt Number LIN................., for review. We are reviewing it, and will notify you by mail when we are done. Please follow any instructions in the notice. If you move, go to www.uscis.gov/addresschange to give us y

Sorry yu hav to go thru dis too . We are in the Sam boat . Mine has been denied since 2015 , hav not heard anything yet .i made an infopass apiontment and there they told me uscis last touched it in April . It has been A long wait , hope Yur s dont 🙏

About a year I would say. USCIS will either affirm or send your wife a notice of intent to deny. Then she sends paperwork addressing the reasons for the denial.

Do you recall what were the questions they asked you at the interview? Usually these sorts of petitions rarely get denied but it happens.

The process for a returned CR/IR petition is :

1. Embassy sends petition to USCIS with recommendation to review or revoke.

2. USCIS sends a NOID/NOIR letter to petitioner listing the reason(s) why the visa was refused.

3. Petitioner has 30 days for a response rebuttal.

4. USCIS if satisfied with the response rebuttal and relevant evidence, re affirms petition and sends it again to the embassy with recommendation to approve the visa.

5. Embassy interviews beneficiary a second time.

The bad news is this entire process can take 12-18 months, some less some more.

Filing another petition with the previous one being still very much alive will cause more problems, you pay again and probably end up

with the same result of refusal and return.

Wait out the process, visit more, gather more relationship evidence, ask your spouse for the exact and detailed questions

and answers during the interview

This are the questions the officer ask me : 
1) have ever travel before, I said no. 


2) what are the things my wife likes, I said,  she likes going to church reading her Bible and going to the gym. 


3) He asked again, have you ever been married, I said no, only with this my wife, then he interrupted and said you are not giving me the correct answer for my questions, 

4) why did not non of your wife's family or parents attend for your wedding ?  I said because she is mature her enough to come by herself and secondary her parents are afraid to fly.

5) what are the things your wife most interesting ? And I told him .

6) what are the funnies thing your wife did recently ?  I said I didn't see any funniest thing she did recently .


7) Then he asked the last question, what are the things your wife  likes about her city, I told him I don't know, then he concluded by saying that, you are found ineligible under section 221 (g) of the immigration and national act (INA) . 
He told me in addition that my marriage is not real, so he will contact national visa center and let them know why he denied me that visa. 
I am really shock by that action at that moment because he had got all the proof of the items they have asked me to bring with me. The wedding pics ,the letters ,the communications between us all in watsup , tango ,messenger and direct line calls .

No please ,I am 100% sure for telling them all the truth and the is no any previous marriage. He was at the point for the absent of my wife parents or family member at the marriage ground.
