I sent evidence for the RFE on May 24th (passport sytle photos of my spouse, and of myself, and proof that I'm a US citizen). Now as of June 12th my I130 petition is APPROVED. We've only been married 9 months, so she will get a conditional visa, which I don't think we will need to do an interview for until our 2 year anniversary approaches.

 

This is what I included in the packet:

2 passport photos of myself, 2 of my spouse

color printed copy of my passport

copy of my birth certificate

copy of my vaccines dating back to when I was a baby (probably not needed)

copy of joint married tax return

copy of approval of her ITIN to work

12 color printed photos of her and I together smiling in different settings over the course of 9 months

Congrats on the approval. I viewed your timeline, which seems similar to mine as I also married last year and filed a 130. I wonder why your interview is scheduled months from your approval, any particular reason besides the slow process? I hope my wife's doesn't take that long. We're expecting to be issued a conditional green card and to have an interview for permanent resident next year.

For my visa type USCIS approved applications are sent to the NVC which is a whole new process which took 3 months to get a case complete.

It seems the Adjustment of Status also made it longer. I'm not sure if we'll have to do AOS as we haven't been married 2 years. Was your spouse already in the US? Mine isn't here yet.

My wife is not here. IR/CR (i-130) visa does not have an adjustment of status, they are a permanent resident on POE.  I was also unaware that k3 visas are still being processed, did you file on your own?

Affidavit of support is the "AOS" listed in my timeline.  If you would like to further discuss the process I went through please send me a personal message and I'd be glad to discuss.

September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

We had to file two petitions we filed the I-130 and 212. The I-130 we received an RFE saying they didn't get a copy of our marriage certificate and divorce decrees. We sent them off right away and in April 12 they received them. It's now been 65 days!!! Should I call? My attorney says to just wait but it's so frustrating! For the I-130 aren't we beyond normal processing time? What do you all think? Thank you!
