I have a pending green card app (family based) and ive passed the interview part. My ead expired about a month ago and i continued to work as an independent contractor but i haven't received any compensation. i have stopped "working" as of now. Can USCIS see if you've worked unlawfully while making a decision on your case? I've filed a 1099 for the 2016 tax year.

Don't know about the USCIS, but the IRS only knows if your employer reports it on the 1099. It doesn't know what periods you worked, they only get your name, ssn, and amount. I would think it the depends on the employer (or whomever you are working for ) verifies your ssn.

I don't understand what you mean that you filed a 1099 for the 2016 tax year, usually the employer does that. If you received a 1099 with amounts then you should have filed with a sch c on our tax return.

Yes sorry for the confusion I meant to say I filed the amount on the 1099 on my schedule c.
