My wife is a USC and plans to petition her brother (Beneficiary) using form I-130.  There are a few questions I have about what to send with the form and Beneficiary family members.

 

  • When assembling the I-130, should only the primary Beneficiary's documents be submitted?  Meaning the Birth Certificate of the Brother.  Or should the documents of all persons listed in the Beneficiary section (Part 4) be submitted?
  • If only submitting the Beneficiary's documents initially with the I-130, when should the documents of the Beneficiary's family be submitted?

I submitted, my BC and my brothers BC showing same parents with similar spellings in both of the BCs.

I compiled document listing my brothers family members (wife and kids) and send this along the I-130.

 

They will ask you to submit the other documents anyway. Later on,when I received my brothers Marriage Certificate and kids BC, I sent these to USCIS.

It's one I-130 to cover them all. The sister would be the beneficiary and their spouse and kids would be derivatives. It will take about 15 years for the PD to become current (assuming the category still exists in ~15 years).
