Hi again! My love & I are wanting some clarity re. the medical examination form. I have read people saying that it's OK to get the examination later and bring I-693 to the GC Interview, and we have been going with that, but I'm reading the instructions for I-485 and it seems like it's required? We are working around the clock to get this out while she's in status, and we have roughly a week left! So we have to figure this out right away.... thanks!!

Generally if you and your partner filed for K visa and now adjusting then you would have to bring medical exams to the interview but if you are adjusting from other type of visa like B or F then you will have to send in the examination IN your AOS package otherwise they will issue a RFIE for it

Also don't worry about filing for AOS while she's still in status. They don't care about it. I filed around a month after I went out of status and they have never asked about it. Take your time and prepare all documents. It's not worth a rush

It doesn't have to. My husband did AOS from a student type visa, we brought the medical with us on interview day. They will just send you a notice about how it is missing and you must bring it that day.

NOA1: Feb. 20, 2015.

Transfer to CSC to balance workloads: August 2015

1)First Master Calendar Hearing: Sept. 9, 2015-Continued based on pending i-130, new court date in 6mo.

Congressional Inquiry: Dec 8. 2015

***i-130 APPROVED WITHOUT INTERVIEW: Dec. 21, 2015** :dancing:

2)Second Master Hearing: March 9, 2016- Removal proceedings terminated w/o prejudice based on approved i-130!! Remanded to USCIS to begin AOS process :dance:

Filed AOS packet: March 16, 2016.

NOA1: March 21, 2016.

Biometrics: April 20, 2016.

RFE Initial evidence: April 21, 2016 for birth cert/translation and Q1/B1 i94s

RFE response received: May 10, 2016.

EAD approval: May 25, 2016- Card arrived at attorney's office! Could not pick up until May 30 because we were at Disney World again :):D

Notice of missing medical exam: July 2016 (Done on purpose to avoid expiration, we will bring it to the interview as stated in notice)

Inquiry about case status: Sept 2016- Case pending interview at local office.

Inquiry about case status again: Oct. 2016- Due to factors not related to your case, anticipate a delay in processing

That's weird! My friend got a RFIE for it as soon as they received the package . Maybe they've changed something?

Possibly, things with immigration can change at the drop of a hat. His AOS was approved in March of this year so it must be a recent change!

Adjusting from VWP here as well.  We did not submit the completed I-693 form with our package.  I included a reason why on my I-485 cover letter. I am just waiting for the RFIE to come.

 

According to USCIS,  

Quote

 If you are applying for adjustment of status, you may submit Form I-693 in one of the following ways:

  • Submit Form I-693 by mail, together with your Form I-485, Application to Register for Permanent Residence or Adjust Status, to the location specified for your Form I-485 (see “Direct Filing Addresses for Form I-485”).
  • Submit Form I-693 by mail, after filing your Form I-485, to the location specified in your most recent communication with USCIS (for example, a Request for Evidence letter from USCIS).
  • Submit Form I-693 in person, at an interview in a USCIS field office (if an interview is required).

The reason I did not submit the I-693 form was due to a delay from the Civil Surgeon I went to.  It was completed a day before my I-94 expiration. A fault on my part.  I should have researched more beforehand.

If you do not attach I-693 with AOS package you will get a RFE but your application won't be denied. Check the processing time for your application: if it may take more than one year then you can wait for the medical exam because it is valid only for one year and you will have to do it again. (My attorney said that!).
