Previous I20 terminated can I apply for new F1?

Long story short my previous I20 was terminated around 9 months ago because I failed to maintain full time enrollment. I was going through a difficult period in my life after the death of a family member. ( I'm a straight A student and had been enrolled for already for 3 years without any issues doubt that even matters). I was planning to apply for reinstatement while gathering the necessary documents I realized I needed some time off my study. I left around 7 weeks after my termination.

 

  • -Have I accrued any unlawful presence?
  • -Am I barred from entering the country again?
  • -Can I apply for a new F1 visa again? Are my chances slim?

 

I remember on the DS-160 that I filled out last time it asked "Have you ever violated the terms of a U.S. visa?" So since I have violated the terms am I going to be automatically rejected or will I still get an interview chance? is there anywhere to explain my story on the DS-160 or should I tell the visa officer? I feel like I'm screwed but I do take full responsibility the worst thing is I wanted to change my major so I applied as a transfer and was accepted to my dream school (UCLA). Any help/suggestions would be greatly appreciated.

Start by contacting the old F1 college's and also UCLA's international office and explain the situation.  They should be able to advise you on the available options and eventual outcomes. Everything will be available in your Sevis record,  so, as always, be truthful.

I think that 7 weeks might be alright because you usually have like a 60 day grace period. 

 

You should contact UCLA's international student house/office and send them scan version of your i-20, i-94, date of you left, etc. 

 

I think that your chances of F-1, if you did everything correctly, are fine. You might want to ask the former school for a letter explaining that you had a personal problem and that you wanted to go home (or whatever happened) so they terminated your i-20. You probably want to take your transcripts to the F-1 interview and maybe take the death certificate of the family member (I'm sorry about that). You want to show it was a personal problem and not that you were ditching class. 

 

I've seen undergrads take a leave of absence when they have a personal problem and for international students, being far from home makes it so much worse and more difficult because you cannot go home for the weekend. So I don't think they will deny your F-1, particularly since you are allowed to transfer to a much better school which means your are in a good academic standing.

 

To be honest, I think your school should have given you a leave of absence and not terminate your i-20.
