Alright, I am confused. My wife's Permanent Residency runs out in January, 2008. Her permanent Residency Card is a normal green card but it was only good for 2 years. Do I still apply with the I-751? Even though everything she has says perminent resident and nothing about Conditional? When should I apply? I am thinking of doing it now before rates accross the board go up.

Yes, you still need to file Form I-751 to remove conditions 90 days before her greencard expires.

You can not file now... it will be rejected... you can only file within the 90 day window... ie 90 days before the expiry date on her greencard....

Your wife is a conditional permanent resident. In order for her to remove those conditions she has to file I751 within the 90 days filing window prior to her expiry date of the greencard.

You can tell that it's a conditional greencard by looking at the category. Right now it should read CF1 under category on her greencard.

Background:

A permanent resident is given the privilege of living and working in the United States permanently. A person's permanent residence status will be conditional if it is based on a marriage that was less than two years old on the day they were given permanent residence. A person is also given conditional resident status on the day they are lawfully admitted to the United States on an immigrant visa (having been married less than two years and entering on a CR-1 Visa). A person's permanent resident status is conditional, because they must prove that they did not get married to evade the immigration laws of the United States.

When to File:

If you are filing jointly, the I-751 form must be filed within the 90 days just preceding the expiration date on your permanent residence card.
