One of the questions on the DS-160 asks if you had a previously revoked/denied US visa.. and I had to answer yes because of a slight complication that happened while I was on a F1 student visa. I never overstayed and always legally abided by the student visa rules. I wanted to apply for a new F1 visa because the one I was on was expired, and I wanted a new one so I could leave the US freely (holidays, family emergencies God forbid!, etc) during the course of the school. I had not been able to leave the US at all to see family because of this expired F1 visa, even though I was legally still allowed to stay in the US as a student enrolled full time in a school.

Long story short, I left the US to a nearby country to apply for a new F1 and it was denied. I was unable to return back to my school to continue my studies (all that tuition/health care/insurance/books/etc went down the drain.. :( ) because the consular denied me and said I could try to come back with more documentation and have another person look at my case. I had all the bank statements / proof of funds / etc.. but it was just not enough for the consular officer - he wanted a bit more ties to home country. I was enrolled in a US school so it wasn't like I could provide a letter from a company in my home country saying I was employed there (or something like that), even though I had everything else like a house in my home country, a bank account with sufficient amounts of money (both home and US). Financially, I was set. I'm not sure what other documents I could have provided. I also had good grades in school (and I studied REALLY hard to earn them) so it wasn't like I was enrolled in school and partied my way thru life in the US!

My question is, has any one ever been in the same situation yet successfully got their K1 fiance approved?
I know these two visas are completely different, but I just really worry about the fact that I will now forever have to answer "yes" to the question about a visa denial. It wasn't that I did anything wrong/bad at all. Of course I explained in the comment section the circumstances to why the visa was denied. I hope that does get taken in to consideration. If anyone had a similar experience, I would love to hear your two cents!

Lots of people are refused non immigrant visa's and subsequently immigrate.
