Recently got married on a J1 visa. Need some help

I am here on a J1 visa and its about to expire in a little over a week. Is it okay if I file the forms after my visa and I-94 expire? .

My husband and I are working on the I-130 and I-485. We have most of the documents for the I-130 but I'm waiting to get a medical exam done and I need my birth certificate from my home country. I would like to make sure that I have everything for both the forms and that I'm not missing anything. Is this list below correct? Am I missing anything?

 

I-130

1.Cover/Contents page with an paragraph and information on what's in the package

2.I-130 and I-130a forms fully filled and signed

3.Birth certificate (Petitioner) and Passport copy (Beneficiary)

4.Filing fee of $535

5.Evidence (Marriage certificate, receipts, affidavits, Joint bank accounts)

6.2 Passport styled photos (Petitioner and Beneficiary)

7.G-325a for both petitioner and beneficiary (Is this document required?)

8.G-1145a e-Notification

 

I-485

1.I-485 fully filled and signed

5.Birth Certificate (Is this required?)

9.Filling fee of $1140 + $85 for biometrics

Since you're on a J1, do you know if you are or are not subject to the 2-year home residency requirement?

I also filed those forms while on a J1. What's important is that you file everything before your 30 days grace period ends, that's 30 days after the end date on your DS-2019. But yes, are you absolutely sure you are not subject to 212 residency requirement?

 

Also, if you are sending the latest and most updated I-130, the G-325A is no longer required for either person. For the petitioner they've included that information on the I-130 and for the beneficiary you have to fill out I-130A. I hope this helps. Make sure you read carefully the instructions on the USCIS website since this is a recent change (we filled on May 11, 2017)
