Hi everyone,
 
My family and I had attended the visa interview at the US Consulate Hong Kong on 3 February 2017. However, we were not able to obtain an immigrant visa because of my father's ineligibility to get a police certificate. The US Consulate Hong Kong allowed us to file for an I-601 waiver. During the interview, an officer of US Consulate told us that if they do not receive any documents regarding our immigrant visa case within 1 year, the US Consulate Hong Kong would close our case permanently.
 

In early May, our application of the I-601 waiver has been sent to Nebraska Service Center and they have received it on May 19, 2017. We have enquired the Nebraska Service Center about the processing

time of our I-601 waiver. They said that it would take more than 10 months to process our case, which will be completed on February or March 2018, approximately. Considering the excessive processing time of I-601, we might not be able to obtain an I-601 waiver by 3 February 2017. 
 
I have contacted the US consulate today, they said they would not extend the processing time of our case. 
 
In this case, what should I do with this difficult situation?
I would be very grateful if you could help me with this situation.

Did a lawyer prepare the I-601?  If so, maybe they could contact the embassy.

Contact a congressman.  Have them send the embassy the USCIS processing times page that show I-601 processing date and inquire about an extension.  It is not an unsual request.

 

Sorry you are having this infortunate issue.  It would be nice if the consulates were more reasonable and logical to deal with.

Yes, the I601 is prepared by the lawyer.

I have told the Consulate HK that the waiver needs to take 10 months to process.

They suggested that we should tell USCIS about our situation if the Consulate HK still haven't contacted us after 6 months processing time.

But I think the USCIS will tell me to request to extend the processing time.

LOL  Oh my goodness.  The consulate needs to get an update from USCIS on the recent processing times.  6 months processing hasn't happened for years.  I would ask your lawyer to contact the embassy.  They're out of touch with current processing times.

Just talked to the lawyer. The lawyer said they will file an expedite after the 6months processing.

It will regard as a time-sensitive case...

I think it's because now we still have 9 months until the deadline.

On November, We will only have 3 months to wait for the waiver.

If we filed the expedite at November, it's more time-sensitive...

I think that's the reason...

Hi has anyone ever heard of being able to extend the time to get your I601 waiver finished, I know you have a year from your interview refusal but \I have been told you can contact the embassy where you had the interview and as for time to be extended. Has anyone else heard of this or know of it happening?
