For five year filers, the only required document is a copy of the front and back of your green card.  You are filing based on your residence, not your marriage or employment.

The IO *may* ask to see the copy of the final divorce decree, perhaps to determine your initial GC/ROC was properly approved, but your marital status is irrelevant to adjudicating your N400 based on the 5-year eligibility.

The stuff regarding your employment, letters from friends/relatives, paystubs and credit report won't even be considered.

I think the divorce decree was a requirement as one of the questions on the application was in regards to marital status, and at the end of the online filing application where you upload documents, it requested specifically a document proving that my prior marriage had ended. Also, I entered the USA on a K1 visa, but life happened and we split up a while after my conditions had been lifted on my green card, and I don't know if that would be taken into consideration.

Also, on the question that said whether or not you have any criminal offenses or something like that, I had a speeding ticket about 3 years ago. It was a minor infraction, would I have to declare that?

Posted

Yes, you have to declare everything.

What you don't have to do is provide documentation for most traffic offences (provided your fine was under $500, you weren't arrested, and your offence didn't involve drugs or alcohol).

Hello VJ filers for Naturalization,

I'm in the process of gathering all the information required to apply for Naturalization for my husband based on 3 years married to US citizen.  He received his  permanent green card on February 2018 and we took a break from all  this process.  As everybody here, I'm assuming that were in the same situation on whether to apply by mail or online.  Can anybody here let me know if applying online is reliable.  We live in New York and we should be filing to Dallas, Texas.  I would like to know if applying online is faster than by mail based on your experience.  Also, can somebody tell me more or less how long is it taking the process if we apply online and if we apply by mail.  That information or any other information that you might provide may help in deciding which way to go.

Is the application online easy to do it.  Please advise.  Thanks a lot for all your help in advance.

Doesn’t make a difference, apart from the week or so that you will gain filing online by not having to wait for your package to be delivered.

Online is easier, as it leaves less chance for mistakes that you could make filling out a physical form, and removes some questions that aren’t relevant to your situation based on other answers you give.  You also rule out the chance of your package being lost/damaged in the mail, or being lost/damaged/entered wrong when it arrives at USCIS.

Personally, I see zero point in filing by mail.

As for processing times, it depends on your local office’s workload.  You can get a rough idea here: https://egov.uscis.gov/processing-times/

Thanks a lot CJKylie for your prompt response.  I saw that you recently applied online and I would like to know if it was easy upload all the documents because I have always submitted all the previous application by mail so this will be my first time online.  I checked the link that you sent me and it is saying 16.5 to 18.5 months in Dallas Texas and 11 to 21 months in New York City. Is it actually taking all that time because I thought that it should be like 8 months.  I also would like to know if I apply online if I can pay with my debit card.

Thanks,

Maite

Yeah it’s super easy to upload everything. I uploaded like 20 PDFs lol. The whole application process took me less than an 40 mins I’d say.

Unfortunately, I believe the estimated time is fairly accurate.  My local office is showing 10.5 to 15.5 months, and on my actual application is showing 12 months estimated.

I paid by credit card, but I assume debit card would work.

Like I said above, the divorce stuff might be asked for considering the marriage ended, but your marital status isn't a determining factor for approval/denial at this point.  In other words, the IO cannot hold the fact that you are now divorced against you as a sole reason towards a denial since you are filing under the 5-year rule (if you were applying under the 3-year rule, it can be).

With the speeding ticket yes you have to disclose that on the application.

Thank you! That ticket is old, and I'm not sure how to go about getting proof of it, but I could try the county I was ticketed in. 🤔

You could get a driving record from the DMV...that would list no outstanding fines.

Even if the offense was in a county that is not the one I lived in? I contacted the county which I got ticketed in, and they sent me a screenshot of their administration screen that shows my case number, full name, plea, and $0.00 balance. It was a minor infraction, and they don't keep physical records of those, only the more major offenses.

Oh, I also have an email confirmation (I'm a hoarder, apparently) from my e-Payment with that county that shows how much I paid, and the case number. What it doesn't show is the offense or any other information.

The email is your receipt that the fine was paid, should be sufficient.  You may also have the correlating bank statement showing the money being taken out (since you're a hoarder ;) ).

I was excited at this new development, that my hoarding could somehow help me out... sadly, my online checking records only go back to September 2016. 🤣
