Timeline

How does USCIS determine the most recent tax year? We submitted June 2017 but aren't anticipating his interview until January 2018 or later.

 

Are they going to ask for my tax returns for 2018 or will they go with 2017 from the original application?

Tax returns are due  by April 15th (this year was 18th).

I think I asked the question incorrectly. As long as his interview as before April 15 of 2018, they only require our tax documents from 2016, which is what I filed in 2017, correct?

The most recent tax year would be 2016 because it's currently 2017 so he would be taking tax year 2016 to his interview even though the interview is going to be in 2018

Your interview will be before April 15, 2018 (2017 tax due date) so you will not have to take a 2017 tax return.  Should you have 2017 taxes done early before the interview you could take those.  

 

Looking at your timeline, you will probably have the interview and visa before the end of this year so 2016 tax return it is. FYI, London does not even require tax returns of K1s if you have another way to prove income like an employer letter. Very relaxed embassy.

Very appreciated. I'm over the 125% for this past year but concerned about the AOS.

My income may fall short this year (making it a very close call for AOS) if we can't file for it before filing taxes this coming April.

 

Trying to plan ahead and prepare but hard when there are so many things that can delay the process.

Remember you can add assets to make up for income shortfall if you or your new husband have any money in the bank when you file for AOS.

 I have been searching everywhere for that specific information on the USCIS website. I know that he will have a little bit of money that we can put in our bank account. Would that suffice? Do you happen to know where I can find this information?

If you will go to USCIS.GOV and find the menu FORMS. Just click it ignoring the drop down choices. Then you have a page of every USCIS form. That is an invaluable source to bookmark. 

 

The affidavit of support for AOS is I-864, Find it. Click it. Then you will see links to the form and instructions for the form plus other useful information. Those instructions tell you a lot more than you will read in a forum post. Look for--

  • Part 7. Use of Assets to Supplement Income (Optional
  • Item Number 5.a. - 5.b. Household Member’s Assets 
  • Item Numbers 6. - 9. Assets of the Intending Immigrant.
