Hey guys,

 

I have submitted my application; but then they mailed me a letter for further evidence. I am confused because I've sent engagement pictures, my ticket copies, other pictures in Kuwait, chats. They need more evidence before we preceded to engagement; and my fiancé has been in Kuwait since he was 5 years old but he is from Pakistan. It also says in the letter that the hometown of beneficiary is Pakistan and you have met in Kuwait. We are family friends (I use to live in Kuwait before I moved to US in 2003) but last time I met him was in 2012-2013 which I have no evidence for and that time we were friends and use to chat on yahoo then decided to get engaged in 2016.

Any help would be greatly appreciated.

So give us more information to help you out. You started talking again in 2012-2013 sometime, got engaged in 2016. You said you had pictures and tickets. How long did you spend together in Kuwait? Did you visit that once only and get engaged same visit? 

 

If you have no evidence of being childhood childhood friends or of meeting several years previously it is as though you just met. Could you send affidavits from family? Get copies of old passports showing previous stamps from

Kuwait? Childhood photos from Kuwait? Proof of your schooling in Kuwait? Even if he's not there it proves you were, showing you were in Kuwait as a child and how you may have met as children. 

 

Do you have archived emails emails on Facebook or anywhere else from years ago? 

 

You need to be creative to give them the information they are asking for in a verifiable way.

So you haven't met in the last 2 years? Have you submitted a waiver for that requirement?

Assuming you are at the I-129F stage...

 

When is the last time you met? When did you file the I-129F? What evidence did you provide for meeting at least once within the past 2 years?

 

Photos are secondary evidence, and chats generally won't hold any weight as evidence of meeting within the past 2 years. Boarding passes, passport stamps, hotel invoices, etc. are good.

That's the big issue. You didn't meet within the past 2 years. This is only permitted with a waiver for very specific purposes...and honestly it's extremely rare to obtain this. You've met before, so why couldn't you have met again?

Yeah I have only met once and got engaged at the same time; my visit was from Dec 22, 2016-Jan 4, 2017 and I got engaged on Jan 1st, 2017. I am trying to find chats on yahoo for 2015-2016;  the last time we met was 2012 dec at my sisters wedding but they ve asked for proof for past 2 years. I did not submit a waiver. The trip that I got engaged was the first meeting; I filed my papers on feb 27, 2017; I provided plane tickets; passport copy for my visit dec 22, 2016- Jan4, 2017. I thought the time I got engaged will be part of the evidence that I've met him in past 2 years.

You said they were looking for evidence BEFORE you proceeded to the engagement. If that's what they asked for then you need to provide evidence of a relationship from BEFORE you got engaged. If they want proof of your visit from a few months ago, do you have other things to show besides photos? Receipts from your hotel you stayed at? Train tickets, restaurant receipts, anything? You need to find out what they are asking for and give it to them. You were in Kuwait for 13 days and got engaged they want to know how long and the nature of your relationship BEFORE it sounds like - maybe they are questioning that this is a bonafide relationship and not something arranged, if your families were friends when you were children.

I stayed at a family friends apartment; and I do not have any hotel receipts; I only have pictures of us going out which I ve sent them with the package. If I can pull up a previous chat from 2015-2016 do you think that should be good enough?

I don't work for the US government, I haven't reviewed your case so it's hard to say. Maybe from your sisters wedding? Even if you aren't in the pics together but to show you we're there? I would ask your family and his to write letters of support too.

Yeah I'll get pictures from my sisters wedding; and tell family members to write letters of support.

This doesn't make sense. You say you got engaged the first time you met at the end of last year/beginning of this year. Then you say the last time you met was 2012. No wonder USCIS are confused!

Nice to know I wasn't the only one confused! 

 

If you (the OP) met him in 2016, did you provide any evidence of your trip in 2016? And did you put that on your application (that you had last seen him in 2016)? If you saw him in 2016-17 but didnt say that in the I-129f, I'd recommend adding that info to whatever evidence you send back to USCIS. 

 

And if you did NOT meet/see him at the end of 2016, and last saw him in 2012, then I think you're going to get denied since you haven't fulfilled one of the requirements for the K-1.

I met him in 2012 for sisters wedding but that does not count as it does not fall in to two years account. Then I met him 2016-2017, and got engaged, Does this make sense?

Hello!
You can provide for them what kind of evidence they needed from you. Focus on the letter and check carefully then provide it and send to them that is a better way to convince them and get approve..
