Incorrect. All spouses must complete an I-130A. Spouses who are overseas do not have to sign it but all spouses must complete this form.

OP, in what capacity are you "living in the USA"? With what visa did you arrive? Or did you arrive illegally? The answers to these questions will help us give the information you need regarding your next steps. I have already moved your thread to the "adjustment of status" section as I am assuming you entered legally so you will be eligible to file an adjustment of status based on your marriage to a USC and won't need to return to your home country and apply for a visa.

Thank you for your feedback, to be specific, I entered the US legally through Canada on land over a year ago and have been here since then. I am a Canadian citizen married to an American and we have two children ( Both US born).

I also would like to apply for my work permit and other forms that help my status. As i mentioned, the page on here in the guide section is great, but given that's it's not really updated with the i-130A, Im wondering what else it's missing. Is there an actual updated completed guide I can follow? The gov site is so vague.

Hi ST29.

  2. I-130
  3. I-130A
  4. I-485
  5. G-325A
  6. I-864 Affidavit of Support

I just submitted mine recently.  All main forms (I-130, I-485, I-1765 & I-131) were received and accepted by USCIS.

Hopefully VJ admin would update the guides soon.

Good luck! :)

Thank you so much for you detailed response Angelica, quick question, did you file two different packages within one big envelope or you put all those forms on one big envelope package?

You're very much welcome ST29. :)

I filed 1 big envelope with 2 packages via USPS to Chicago Lockbox.  I made a cover letter for each package. One for I-130, with supporting documents.  Another for I-485, I-864, I-131, I-765, with supporting documents as well.  I used fasteners & binder clips and put tabs at the bottom for easier reference.  Link for Form Filing Tips from USCIS website. https://www.uscis.gov/forms-filing-tips#Assembling

I did not include the I-693 Medical Form because it was not completed when I submitted my application.  Just waiting on the RFE for that.

One more question Angelica, was the fee for some of these other forms waived off when you submit with i-485? In other words do I just pay the fee for i-130 and i-485?

Yes.  Fees for I-765 & I-131 are waived for concurrent filing applications. $535 for I-130.  $1225 for I-485, that includes $85 for biometric services fee.

St29 I'm glad you got the help. I have been trying to find an answer to my question regarding the form I-864. I got the form sent by my friend who is helping me and sponsoring. I explained to my friend everything needed for this matter. However, when I received the form I checked it out and found that all the 12 pages needed were printed out on 6 papers and each paper were printed on both side like front and back so the front one page and the back is the second page that follows and so on. Plus nobarcode printed but my wife told me wasn't necessary since they don't scan it. The question is that is it okay to submit the form that way? I mean everything is filled out neatly and all information is there but each paper printed on both sides including two pages of the form. One more question is that the tax transcript and w2 are copies is that okay? Any reply is much appreciated I need to know I have been waiting for more than a month to receive the papers and don't have much time. Tnx
