Why did my fiances case got sent back to USCIS after his interview in Kabul?

Timeline

Isn't it hard to get a visa for a Afghani national to India? Also, he would be able to live in India? I hope it works out for u both but I think it might be hard to live in India (him being from Afghanistan). I might be wrong.  I hope I am. Have u thought about Turkey? I heard it is easier to get a visa there and then prove income and he can get residency.  I wish u both the best!

One other thing to consider is research the laws of getting married in a third country when both of you are not legal residents in
India. For some it is very difficult to get an application for marriage approved in that situation but I have no idea about
what someone from Pakistan needs in documents to marry a USC in India.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Afghans don't need to get a prepaid visa to visit India.  They can get a free visa upon entry.  However, this is not a work visa.  He must know someone in India who will sponsor a work visa for him.  Hopefully, he doesn't work illegally in India because he will need to prove his legal residence in the third country for the US visa.

 

Afghans have a nearly impossible way to get a Turkish visa; although they can easily illegally immigrate to Turkey.  When my guy and I were going to meet, we wanted to marry, and Turkey is a good third country to marry in, but getting him a visa was nearly impossible.  Marriage in India takes at least two months for two non-residents.  If he gets a work permit in India, maybe it is less time.

 

This is coming from a wife of a former interpreter - not guard - interpreter whose brother-in-law was an interpreter for the US military.  All the Afghan interpreters are in Kabul and they are mostly safe.  The Taliban are not an organized mafia to track down a guy that comes from a village.  My father-in-law built his dream home, but then the whole family had to flee because they had received death threats in the village.  They were fine in Jalalabad.  They were fine in Kabul.  Sure, it's as safe as Chicago.  My husband cannot go back to their home village, but he was able to return there for a month long visit this past month.

 

Why did he not apply for SIV?

 

What can happen is that a family member thinks you have money and if they can't get it from you, they may have you kidnapped and sometimes killed.  But that's for several thousands - $50,000+.  The family has to be pretty rich to have that happen to them.  Regardless, if he applies for a marriage visa in India, he will come across the same scrutiny.  Don't think that there is a "MENA" stigma that can be avoided.  Many people from UAE or Kuwait get approved easily.

 

The good thing is that you would be able to live in India with him as you wait.  That was our back-up plan and I was preparing myself to improve my chances of getting a work permit in India.  I don't know if that would have ever worked, but no matter what your plans are, just start building your life as if you would be denied.  That way, nothing on the visa journey will scare you!

It is not considered evidence for a relationship/marriage to have a child together. I advice against it for 2 reasons:
First and foremost, he as the father will miss a lot of baby's "firsts", supporting his pregnant wife, being there for the birth etc.
It can take much longer because even if he is not in a MENA country he can still be put in long AP time for security checks
and background checks because he is from Pakistan.
Many couples who get pregnant have a 2 year old child that Mom raised alone and being totally overwhelmed because Dad couldn't join yet
and is still stuck in the process.
Another reason is they could request DNA testing which costs (about $800 and added months delays) to make sure the child is his.
Third reason, the adjustment upheaval for him to move here will be hard enough without throwing a child in the mix in my opinion.
I would settle as a couple here when the time comes, let him become stable with a job and income, adjusted, growing your 
relationship together, then plan for a child. All this is very, very stressful and you won't realize this until you are at each phase.
That is a very personal decision though and it is just what I would do, not everyone would agree.
Other than that, yes, wedding in India with his family in attendance would be fine. It will not speed up the process neither
hold it up in itself and if you are both safer there then that is a good reason.

Sorry, of course Afganisthan, that's what I meant, got mixed up.
If parents can't come write in the relationship letter the reason why, keep it short and to the point.

Getting an Indian work visa is not the easiest thing.  I would not recommend he overstays an Indian tourist visa nor work illegally in India.  If he applies for a US visa from India, he will need to show legal residency in a third country.
