I-824 Form Question

Filed: K-3 Visa Country: Pakistan
Timeline

Since my I-29F and I-130 approved at same time, I want to go for I-130(CR-1).

I am in process of filing form 1-824 but get stuck on Part 2 (Reason for Request)

Since I want my I-130 process should continue and not K3, which option should I choose?

A. A Duplicate Approval Notice

B. USCIS to notify a diffirent US Consulate or Port-of-Entry about the approval of an application.

C USCIS to notify US Consulate that my status has been adjusted to permanent resident. Please notify US consulate.

D. USCIS to send my approved immigrant visa to National Visa Center(NVC)

E. USCIS to notify the US department of state of my US citizenship status.

Since my case was approved from California Service Center, I think CSC should send my I-130 to NVC.

So I think I should select "D", am I right or I am missing something?

Please give me a clue.

Yes, it looks like choice D would be your answer.

I've seen a few posts from VJ members here who filed the I-824 and they've said it takes about 6 months or so for it to be processed. Just a thought.

02/05/07 - I-130 sent to NSC

05/03/07 - NOA2

05/10/07 - NVC receives petition, case # assigned

08/08/07 - Case Complete

09/27/07 - Interview, visa granted

10/02/07 - POE

11/16/07 - Received green card and Welcome to America letter in the mail

Removing Conditions

07/06/09 - I-751 sent to CSC

08/14/09 - Biometrics

09/27/09 - Approved

10/01/09 - Received 10 year green card

U.S. Citizenship

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

Yes, it looks like choice D would be your answer. You probably know this already since you're already filling out your form, but are you aware that the I-824 takes about 6 months to process? Just a thought.

No, I did not know this. but I really want to go for CR-1 route. what other option do I have?

If you want to receive the CR-1 visa, then that is the only choice you have now. If you don't want to wait that long for it to be processed, then you can just go witht he K-3.

I think the best thing to do before you file is try to find the posts made by people who've filed the I-824 and see how long it's been for them. OskaryAndrea is a member who had to file it since her K-3 visa was denied back in February, she might be able to answer any questions you might have and she's really nice and very helpful. ^_^

I am actually going to the Chet Holifield building 3rd floor and personally ask someone at USCIS in two weeks.
