So I'm almost done with filing the application, now the only thing that concerns me is my arrest from last year which was engaging with a prostitute. Now this was my first offence ( a misdemeanor ) Now I was the one who called the cops because the lady was crazy and etc. Anyways, after getting arrested and going to court my case was dismiss and instead giving a ticket for public nuisance. I got the disposition showing the charges were dismiss however, in the police report it shows how I was looking for a prostitute and etc. Now my questions are will this affect my k1 visa application? Also, during this time i was with my girlfriend (laos) however, she doesn't know since I haven't told her. I am planning to but never got the courage to do so. Now my concern is if the embassy will bring this arrest up to her? And also, do i have to check the box yes in the I-129F where it says if I've ever been arrested and explain that I have been engage with a prostitute or public nuisance?  I really need some advice and help regarding this. All help is welcome and appreciated. Thank you so much for taking your time to reading this.

first thing you need to do is come clean with your girlfriend. And you should never lie, so you should check the box that yes, you have been arrested. You'll probably need to add the additional documents showing case dismissed.

As above, be honest and put yes. Even if it was 'dismissed' or 'dropped' it is still on record. Supply these records in the petition.

 

Like above also, tell your fiance about this because they most likely will bring it up to her in the interview phase at the embassy.

 

They generally do ask if people know about their fiances past and all.. better to come from you now than the CO then.

Why do you think they conduct background checks? Why do you think you need a police certificate as part of your evidence?

I definitely read somewhere that some embassies (certainly the UK) will inform the beneficiary of the USCs criminal record at the interview stage, so first and foremost is honesty, both in the application and to your significant other.

You definitely need to tell her. The fact you looked for one while you were with her is bad and they'll know the timeline of when you met, plus the arrest. So, they'll definitely put 2 and 2 together. The new forms ask about ANY arrests not just certain ones, so you definitely have to disclose it. 

 

Could it have an impact on the outcome? Possibly, but if you lie it will be much much worse. (not to mention illegal) Even if you somehow get away with it imagine if she finds out about it later. It would be horrible and keeping secrets in a relationship isn't good. 

 

You obviously have to check the yes box and explain everything and include the paperwork you have.

I could be mistaken, but it sounds like the owner of this thread is the US citizen. If so, then tell your soon to be or your fiancée and I doubt she/he will a huge problem especially if its your only time u tried this.  Your fiancée would be concerned if you have done it in the past and didn't get caught.  But yeah I would tell your fiancée first.  You must check the YES box because you did get arrested then you can explain the case was dismissed.  Good luck

ohhhhhhh, I missed the part he tried while he was with her.  Oh man, that's not good and I am not even thinking about USCIS

Relationships have issues - it only makes the relationship more real and genuine to know you had the issue and worked through it.  In terms of affecting the application, sure , but I'm sure with honesty and a full explanation, the CO and USCIS are aware that not all relationships are perfect!

I'd say depending on how long ago it was and how long you've been together since would make a difference. I'd suggest telling her before you apply, that way it clears the air. The dismissal should help, but basically you pleaded out and they just lowered the charges for a plea I'm assuming? That's fairly common. 

 

The thing is the embassies are concerned about prostitution and women being sold and things like that. So, obviously it's somewhat of a red flag. However, others have had much worse things and have been fine. 

 

Be honest, tell her and see what she says. Then just go from there. 

 

Good luck! Oh, I'd also suggest at least talking to a lawyer, don't necessarily hire one, but you can get free consultations.

This happen when me and her were together for 5 months already. Also this happen 1 year and 4 months ago. Since then I haven't gotten arrested. I've revisited her and etc. I don't know if the charges will be a big affect on determining if our relationship is bona fida. Also, yes I have pleaded to plea for it to drop and get a ticket instead. I was wondering if i should i explain why i would look for one due to being a stressful time. But I doubt that will have any affect.  As far as i'm reading it's most likely my application will be denied? Also I know Laos are in particular strict with laos women being as prostitutes so i believe my case will defiantly  bring a red flag.

I don't know about saying why you did it. Embassies don't generally like "excuses." I don't think you'd necessarily get a denial, you just might have to jump through some hoops.

Like I said before get a hold of a lawyer and see what they say and talk to your girlfriend. Lawyers have dealt with all of this stuff before and should be able to give you a better idea of your chances.

Sounds like you're getting good immigration advice. You might also want to review your entire sexual history and do a little soul searching. A group like Sex Addiction Anonymous might be something to check out if this isn't an isolated incident. Infidelity isn't necessarily a marker for sex addiction, but sex tourism, especially when repeated, often is. Good luck.

You must tell your gf.  She may be questioned at her interview and she must have the correct answer.  You also must answer each and every question posed by the government with complete honesty.  Lying includes leaving out pertinent information.  ALWAYS BE HONEST...NEVER LIE.   And one more thing...  What in the world were you thinking when you hired a prostitute?!  Seriously?
