Can i AOS while on a humanitarian visa?

Hello, i am from Mexico,

i used to have a us-tourist visa. My visa was revoked due to a run-in with the police. I was charged withh a first offense misdemeanor (prostitution). The penalty will be most likely community service or the case will be dropped. I will be given a humanitarian visa to attend court soon. I dont know how long the visa will be issued for. Im guessing a short amount of time.My fiance and i had already talked about marriage, but this mess that i am in is making us want to do it sooner than we planned. I have a few questions:

-can i adjust status while on humanitarian parole.

-can i overstay my parole and still be able to adjust status

-will the prostitution misdemeanor have a negative impact

-will it look fishy to them if i apply to adjust status given my situation( revoked visa, in a legal problem)?

I am sorry to hear about your predicament.

 

The prostitution misdemeanor will most likely be a problem, because on the forms (especially the application for adjustment of status) there is a question regarding participation in prostitution etc.

 

I would suggest you do everything through the proper process...get married, go back to Mexico, have your husband petition you as a spouse, get an approval and wait for the visa to be issued. Do not overstay. This might result in you getting banned.

I definitely will be seeking leagal help from an immigration attorney. I would just like to see if there is anyone out there in a similar situation as i am, and what their experience was like.
