5 Year Relationship finally making the Move

Timeline

Hello everyone, 

My name is Kylie and I have been in love with my now fiance, Tom, for 5 years now. Last year, he proposed, and we want to get married in a year. We would want him to come during next summer for good. He is from England and will be moving to Montana in the US with me. I am just starting the paperwork and need some advice, help, tips, encouragement, and all of the knowledge you guys have. We were almost scammed $5000 worth over a lawyer who claimed he could speed the process up by us getting married on a tourist visa. Tom did not want to risk our future together and waste that much money, so we are doing it the RIGHT and legal way! Needless to say, after that, I am stressed. We have plenty of photos, hotel and flight receipts, etc. for evidence, but I am concerned over that, the paperwork, and the processing time. Are there any other couples out there who are currently in the process or just finished?

Nothing to be stressed about. Take your time and learn as much as possible. Use the guides for help and feel free to ask questions.

K1 takes about 6 - 9 months if there are no problems.

 

Also, report that lawyer if you can.

I agree, don't stress out, the process is easier than it may look.  Also, I am glad you came to your senses regarding the lawyer before you ended up losing money.  Many people use lawyers, and there are good ones out there, but I would definitely run away from anyone claiming to be able to speed up the process.  To my knowledge, no lawyer can do that.

 

Just start with the guides that you can find in the ribbon here at VJ.  Ask questions as you need to as there are a lot of members willing to give you good answers, and don't stress out.  As Nuestra said, K1s are currently taking about 6-9 months, so start now and you may be able to get together physically soon. Just one piece of advice, don't make any plans for a wedding until your fiancé has their visa in hand.

I have to say your boyfriend is smart.  Entering the US with the intent to marry on a visitors visa is visa FRAUD.  You could be banned up to 10 years if you were caught.  Good luck, follow the guides and God Bless

You are 100% wrong.  Entering the US "WITH THE INTENT OF MARRYING" on a tourist visa is ILLEGAL and is immigration FRAUD.  Of course I've heard of destination wedding...I live on Maui.  But that's not what we are talking about here.  The OP said that an attorney was going to charge them 5000 dollars and he would show them how to enter on a tourist visa and get married.  That is intent.

I believe its actually that entering on a tourist visa with the intent of marrying AND staying permanently or adjusting status is Visa fraud and therefore illegal.  Of course, getting married on a tourist visa is perfectly fine, but definitely illegal if you plan to marry and remain.

That's correct.  But it has been suggested that a "Destination Wedding" could be planned and the fiance enters on a tourist visa knowing full well that he/she is getting married is definite visa fraud.

Only if they plan to remain after getting married.  I think you both are getting wires crossed and essentially mean the same thing to be honest.

Here is what the OP posted:  " Last year, he proposed, and we want to get married in a year. We would want him to come during next summer for good."  Sounds like it would have been visa fraud to me.  But the OP has decided against using this method and wants to do everything legally.

I am not disagreeing with you. I'm disagreeing with the blanket statement that getting married on a tourist VISA is illegal.

In the context of OP, absolutely it would have been a case of fraud and totally illegal ( I never stated otherwise)

Like I said, I think you guys had a miscommunication.

It would have definitely been illegal and the lawyer purposely said that. My fiance would have to lie about his reason of being here and the chances of getting caught was too much. We want to do it the right and legal way. The lawyer's reasoning was that he said my fiance would have to wait 9 months to work in the US if we did it the legal K-1 way. He said if we get married on a tourist visa, he would only have to wait 3 months to get a job. We found out that was a total lie and eventually led us to filing the K-1 visa.
