Expediting EAD from AOS with current L1 visa

Hi all,

 

I'm currently in the USA on a L1-A visa, and married to a USC (my wife). I got a much better job offer in a different company, and I'm wondering if it's even possible to ask for an EAD expedite in my situation, since I'm currently working (with the employer on the L1-A).

 

We have applied for an AOS, and my NOA1 date is 2017-04-17. My receipt number starts with MSC (not sure if everyone starts with MSC and then moves to the local field office?). I'm worried, because looking at MSC processing times, they look much worse compared to others by a magnitude of months, and I'm concerned that I will not get the EAD withing the usual 90 day period.

 

Can I ask for an expedite based on the fact that I do not want to have this offer rescinded, because of the delay? Also, this new job would require me to move from the San Francisco area to Los Angeles, so the more time I have to look for a new apartment, etc, the better.

You can ask, but since you have employment authorisation already (granted, it's tied to your current employer and doesn't let you switch jobs) I'm unsure if it would be granted.

 

The worst that can happen is that they decline to expedite, so it may be worth doing so and just seeing what happens.

So there's no risk of an expedite request failing, and then causing more delays?

It won't add any additional delay, no. There's no guarantee the expedite would be accepted, however.
