Hello,

 

Just need clarification for the I-134. When filling out the I-134, is it solely based on the income of our co-sponsor or combing cosponsor and my income? Also, can the co-sponsor also be self employed that makes enough money but doesn't really pay taxes (he's a handyman)? I have two people who are willing to co-sponsor for my fiance and me, both American citizens. I just want to know who should be the best person to co-sponsor for us.

For the I 134 London allows you to self sponsor.

If you can't sponsor, adequate income or assets, then using a co-sponsor as you have available is the way to go.

 

Both you and the co-sponsor need to provide an I-134 and supporting documentation (pay stubs, W2's/tax transcripts, letter from employer(if can get it), bank statements (if using assets or just wanting to provide them to show savings), ect...)

For LONDON specific cases: When using a cosponsor it must be based on the income or assets of the cosponsor. It's ONE I-134 and financial support info from ONE person. The best person to sponsor will always be yourself, when it can't be yourself it should be a sponsor who can prove their income. Not paying taxes certainly isn't a good thing. Being self-employed doesn't prevent you from paying taxes. London also allows for self-sponsoring, provided the UK fiancé has a significant amount of savings.

Don't pick the one who cheats on income tax. A self employed person who wants to sponsor needs to show he is over the poverty level on Line 22 of his 2016 tax return.

Anyone know what is considered "over the poverty level"?  Just trying to figure out how much my fiancé needs to show on line 22 to be able to sponsor me!

You can find the guideline here. https://www.uscis.gov/i-864p London has been known to accept 100% However for AOS they must prove 125%
