Need some help with I-485, please!!!

Hi there to everyone. Didn't no exactly where to ask my question. It's about form I- 485. I have a problem with choosing the right answer from the list in part 2. My situation is that I came here with J1 visa and than changed my status to F1, was going to school. Got married in 2006. SO what should I put there? Please, help me. I really appreciate it. Thank you very much.

A tip for everyone: when asking about a specific question on a form, it helps to tell us what the question is, because I hate like hell to have to drag the file up and find the question.

Now that's out of the way: it's a). You'll be filing your I-130 which will give you an immigrant visa number when approved (aka A number).

aos timeline:

married: jan 5, 2007

noa 1: march 2nd, 2007

interview @ tampa, fl office: april 26, 2007

green card received: may 5, 2007

removal of conditions timeline:

03/26/2009 - received in VSC

07/20/2009 - card production ordered!

The answer is "A", but I want to ask a different question: As you were originally here on a J-1, are you sure that you are not subject to 212(E), i.e. the 2 year home residency requirement?

What, the 2 year HHR requirement? No. If they were subject to it and never returned to their home country for 2 years, then its grounds for denial of AOS.

Yes. J-1 can be a tricky business. Even if your J-1 doesn't officially state that its subject to 212(E) and your DS-????/IAP-66 says your not covered, you still can be. Former J-1 holders should really apply for a judgement on this from the Department of State.

My former J-1 was the only thing I got really quizzed about in any depth at my interview, despite the fact that I was clearly not covered by 212(E) and had been on an H-1B for 5 years since my J-1 expired.

Second, my J1 visa is not the subject to 212 (E).

So Answer is "I am applying for an adjustment to permanent resident status because an immigrant petition giving me an immediately available immigrant visa number has been approved"? But the thing is that I didn't apply for A#. I should put it anyway? Sorry, for stupid questions....

By filing the I-130, you are applying for an A#.

One does not apply for an A#. The USCIS assigns an A# automatically when they receive a petition or application for you. Once you've got an A# from the first case, if you don't give that number on subsequent cases you can wind up with multiple A#s.
