It sounds like the CR-1/IR-1 visa was applied for, she had the interview, and was refused. They subsequently sent the case back to USCIS. You can reply to the NOID and address the concerns. USCIS will review it, and if they agree, they will reaffirm the petition and send it back to the embassy, a new interview will occur, etc. Nigeria is notoriously known as a very difficult embassy to get through. Good luck!

 

As for the particulars...what does the NOID say in regards to the reason for the denial?

hi guys letter of intent to revoke my marriage from uscis, have been given up to 2 july 2017 to provide more document, just dont know what to do now ever since the day i was put in administrative processes on 24 may 2016, my wife have never come to visit me during o work and upkeeping of our children.

What sort of questions did they concentrate on at the interview?  

How many times did you meet before that interview? 

All you can do is provide what you have- emails, phone bills etc.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

she came once to visit in nigeria, the consular is quarrel that why did she stay just 3 days and that the protography i presented was only done base on the fact i just want to use it distract the consular, she says the photo was just use for the purpose of bringing it along to the embassy

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

So she came only once to Nigeria and you got married?

 

We need a bit of a relationship timeline and some details to better understand your situation. Like ages, amount of time meeting, amount of total time spent together, length of relationship, the kids are not yours I assume, so you haven't met them? ect...

we dating each other from april 2014 and got marriage october 2014, it was october 2014 we both saw last but we do communicate on whatsapp,whatsapp call, face messenger call and also share  mail together as well. have never seen the kids before their my wife kids but i claim them as well as my kids now. the reasons why she  has come back to see me is due to the fact that her work and kids are really taking much of her time and also is not easy for her alone do everything all alone, so that just the reason why she has stay back all this while. and we both discuss about it together

So you saw each other last one 3 years ago... wow. mails and chats don't matter as much as seeing each other in person.

That does help a lot. So, the age difference doesn't sound too bad honestly; but in Nigeria it can still be scrutinized.

 

Marrying on one short trip after 5-6 months of dating online also can be a red flag to them.

 

Only meeting one time for a short time frame is a huge red flag.

 

Not seeing eachother in almost 3 years in person is an even bigger red flag. This is probably one of the biggest reasons for denial honestly. Not necessarily the only reason; but it definately is a negative.

I don't know how it is in your culture but in the west that's certainly unusual. I hate to say it but the embassy was right to be somewhat suspicious. Most people have had toothaches that lasted longer than the amount of time you've been together. Before you rush into a new application, take some time out and spend quality time with each other and her children. Do you have contact with her family members (siblings, parents, etc)? What do they think of this relationship? I'd be worried if my sister married a man she'd known for 3 days and wanted him to live with her minor children who'd never even met him. 

So do I.  In my opinion, let the petition approval be revoked.  It's not your marriage that is being revoked, just the petition approval.  After your wife is able to visit again for at least several weeks, filing a new petition would be a good idea.  Anything else or anything sooner, would be a waste of time, money and emotional energy.

Facts are cheap...knowing how to use them is precious...
