Next steps after I-130

Hi everyone,

 

we recently sent out our I-130 via DCF in Frankfurt. Since we want to avoid any avoidable delays (The idea is to move by October, so there is a little room for error, but not too much) I have a few questions. I'm sorry that there is no better way to title this post, I thought about creating separate topics each, but that seemed more spam-like.

 

1. Joint sponsor: my husbands income was enough for the past three tax returns. The problem is more that I read in the I-864 we also have to state his current (estimated) income. Since coming to Germany in the end of last year he was not allowed to work at first and now there is only some freelance work. Moving back to the US in Fall he will hopefully find a job, but so far nothing in his field (he could get a restaurant job right away if the situation is dire.) I have a fulltime job lined up, that can start as soon as I come back, that should keep us afloat, but it does not count in his I-864. 

 

Does this mean we need a joint sponsor? Because I also read that, if you met the income in the past you can't have a joint sponsor... Anybody in his family will be happy to do this, 

 

2. Police record: German beneficiaries - I would appreciate knowing your experiences with a polizeilichen Führungszeugnis. Did you get the short version, or the long one? Did it need to get notarized or an Apostille? Did you get a translation?

 

3. Medical Exam: Looking at our timeline - I-130 is sent, we got a receipt but no approval yet and plan on moving in October - does it make sense to get the medical exam out of the way soon? It would be valid for 6 months, right?

1.  Yes you need a joint sponsor; foreign income doesn't count, and neither does a job offer, only a job already started (current AND ongoing income).  You would have the possibility of moving a few months before him, and sending back paystubs, but if you don't want to do that, your options are a joint sponsor or sponsoring on assets.

 

3.  I would wait till closer to the interview time.

Better to wait on the medical just in case.

Not sure about Germany but here they didn't require any Apostilles or notarization on any documents, only translation and the original.
