I-130 Question

Hello All.

I filed a I130 petition back on Feb 16th and received my NOA1 on Feb 20th from CSC. In my packet, I had a cover letter stating that I will be pursuing the K3 Visa and will mail out the 129F once I receive the NOA1. It's been recommended to me to just stick with the I130 and not to pursue the K3, as the the timelines are similar. Now, would I have to write the CSC a letter stating that I'm not pursuing the K3? Will they purposely not 'touch' the file, anticipating the K3 process?

It is my personal opinion that they will process the I-130 as normal unless they receive the I-129 form

No just continue with the I-130. If you have not even mailed out the I-129F then you haven't even started the K-3. The letter should not effect the CR1 process. Great choice by the way :thumbs: I personally think its the better visa.

I'm not so sure I agree. If you stated you will be pursuing the K-3, they might retain your I-130. (This has happened to other members.) If this happens you would have to file the I-824 form ($200).

Thanks! I will most certainly pursue the 130, as it's been almost 2months since the NOA1, and there really is no benefit of the faster K3 at this point.

I also chose to go the CR-1 route since I never received the NOA1 for the I-130. I also wrote in my letter that I would be pursuing a K-3, but it seems CSC didn't give a rat's ### about it since I never received the I-797 I needed to file with the I-129F.

I really doubt that they would retain the I-130 until the I-129F is filed and that we'd have to go the I-824 route since the I-129F was never approved either (how can they approve a petition when we never sent it).

Oh I know, I can't believe it either. The only reason why I would love to have it in my hand is to make sure that the receipt # they gave me over the phone is the correct one. I've seen a couple of people who were all excited about being approved only to find out they had the wrong #s all along. -_-

If you do the K-3 it's supposed to be a bureaucratic pain in the butt. My hubby has the IR1 visa and he doesn't have to do anything once we get to the US. The CR1/IR1s are way better than K-3s.
