Hello!

#1) I will be applying for naturalization on September this year but I did not register with selective services. I got my green card in November 2012 through marriage with a USC spouse. I will be 33 years old when I apply for citizenship. In 2012 when I got my green card, I was 28 years old which I know now is past the age for selective services registration. 

When I looked at the N-400 requirements, question 33 got me confused: "Are you a male who lived in the United States at any time between your 18th and 26th birthday in any status except as a lawful non-immigrant?" My problem is I moved here in 2007 when I was 23 on a tourist visa and became out of status between the age 23 to 28. Since I was out of status back then, I did not know anything about selective services. When I apply for naturalization this coming September, do I still need to get a Status Information Letter from selective services before I file my application or is it irrelevant at this point?



#2) I am currently separated from my wife but have not filed for divorce yet, should I put on my application that I am married? Will that affect my application? In November this year, I will be on my 5th year as a LPR.

Any help would be greatly appreciated. Thank you in advance!

1) As an out of status alien, you were required to register with Selective Service, but didn't.

 

For Part 12, Question 44, A, you must answer "Yes". You would leave B blank since you didn't register.

 

Once you're past the age of 31 this isn't held against you, even if your lack of registration is deemed to be "willful" (most of the time it isn't).

 

Part C makes it clear that you're only required to obtain a Status Information Letter from SSS if you're between the ages of 26 and 31; if you'll be 33 then this isn't required.

 

2) For Part 10, Question 1, you would select "Separated". Provided you file under the five year rule then it will have no effect on your application.
