Timeline

Hello!

I've just sent in the K-1 form for my British fiance last week. I just had a quick question since I couldn't find it here.

 

I am 19 years old in college and my fiance is 23. His aunt is willing to sponsor for him when he gets here since I don't make enough money to support the both of us. I've read about the I-864 form. I'm just a little lost on when I should send that?

You sent the I-129f petition. The K-1 is the visa itself and only issued after approved petition and interview.

 

For the K-1, the I-864 form is not used, you will use the I-134 form. I-864 is used for the AOS stage after marriage.

 

His aunt? Is she a USC or LPR? Anyone can be a co-sponsor as long as they are again a USC or LPR of the US.

You are your fiancé's sponsor at all times. However you have said the aunt is willing to sponsor for him when he gets to the US, but if you are unable to be the sponsor for your fiancé, then someone will need to co-sponsor for him to be able to come to the US. You've mentioned that it is his aunt? Does this aunt reside in the US as a citizen or an LPR? Because if it is his aunt living in the UK, that's out of the question. If you have a co-sponsor that has agreed to the terms and requirements, once your application has been approved have the chosen cosponsor send I-134 along with any financial documents of proof (London is easy about this - a letter from employer, pay stubs, tax transcript) to the UK fiancé. They will take this with them to their interview day.

 

Once you marry he will need to adjust his status - that's where the I-864 comes into play. As you will then be a spouse you are always the primary sponsor regardless of your working/non-working situation. If you still don't make enough funds at this time (the financial test is more strict for this form), you will require a joint-sponsor. In that instance both you and the joint-sponsor will need to include an I-864 and relevant documents it requests with the entire AOS application packet.

She is a USC! When the I-134 is being filled: will it be under his aunt since she's co-sponsoring, or will it be me?

His aunt is here in the US with me! Should I start sending in the I-134 right away or should I wait for NOA 2?

I would say send the I-134 and supporting info to your fiancé around the time he arranges to have his medical (this will be well after the NOA2), by that time he will be able to arrange his interview date, so he'll have it in time. Use this thread as a good overview of the process (not much has changed, except that you may now make your own interview appointment):

For the I-134, should his aunt fill it out under her name or should I fill it out under my name? Does the I-134 only go to my fiance or do the embassy also need a copy? Sorry for the questions, I just want to make sure I understand everything. Thank you so much for your help, by the way! I truly appreciate it.

The embassy will only want to see the info from the aunt, so it will be filled out with her name and info.

The I-134 and supporting info will go to your fiancé. He will hand deliver it to the embassy officials on his interview day. He should also expect to potentially answer questions about the co-sponsor - usually easy and general in nature - such as who is the cosponsor and what do they do.
