when you sent in your AOS applications, did you include a form i-130a? My husband found it in the instructions but this is the first time I have heard of it.

thanks!

I submitted my package in June and had to include I-485, I-130, I-130a, I-765, I-131, I-864, 2x G-325a, and I-693 (medical exam). Did your husband enter as a K-1? If so, you don’t need to submit the I-130, I-130a, and the I-693 since you guys should have already submitted them when you applied for the K-1 Visa. Correct me if I’m wrong.

Yes you NEED do submit as well the form i-130.

The i-130 is filled by the petitioner, and i-130a is filled by the beneficiary.

And, also do not forget the form G325,  which is generally required to be submitted with your i-485.

So basically it should be :

i-485

g-325

i-130 (not sure for k1)

i-130a (not sure for k1)

i-864

last year's tax returns transcripts

current year's income evidence (such as a letter from employer indicating current year income)

i-765

i-131

and all other required attached documents, such as identity photos, bona fide evidences, i-94, copies of your passport and visa, etc.

Make sure to read very carefully the instructions of these forms. the instructions can be downloaded on uscis website.

Good luck!

I corrected my mistake, I meant I-130a and not I-131. You don’t need to submit I-130, I-130a, and I-693. You need to add a copy of your K-1 Visa approval (I-129F).

Hi All. I just received today in my mail 2 letters with the approval of EAD and AP, however; in the system the status has not change from case received to approved.

Do any of you have a similar situation?

Thanks

Don’t worry about the online updates. If you received the letters you’re good to go.

If it’s K-1 or K-3 DON’T submit the I-130, I-130a, and the medical. You guys just need to add a copy of your K-1 or K-3 NOA2s (approval).

So basically your package should include:

I-485 + 2 passport pictures

Copy of K-1 or K-3 NOA2 (approval)

I-765 (optional) + 2 passport pictures

I-131 (optional) + 2 passport pictures

I-864

2x G-325 (one for the beneficiary with passport picture and one for the petitioner with passport picture)

The additional documents you need for each form are explained in the instructions.
