Congratulations! It seems that EADs around our timeline are taking at least 110 days to process. Did you raise an SR? I saw your timeline and saw that you have been scheduled for an interview. I was wondering if I was still going to get an EAD since my interview was in a month.

From what I know, the process of i-765 is separated with the process i-485. So you should expect an EAD before your interview.

However, I also saw a case, her i-485 case processing timeline is very efficient and short (3months something?)

and even her interview was finished and approved. she did not receive the EAD.

 

and after receiving her resident card, she also received a mail about her i-765 saying that "since your i-485 is approved and card is mailed before the i-765, so you won't receive an EAD".

 

But this is just a case that I read online, I do not know if it is true or not.

 

Anyway, my personal feelings are : Before the interview, you should expect an EAD; after the interview and your case was approved, then probably you will not receive an EAD. Logic? Because the functions of EAD are overlapped with resident card, you are not expected to  have both cards in the same time, that's why (I guess) after the interview, if the case was approved, the interviewers always draw attention to return EAD cards to a specific office.

We filed in June as well along with EAD. Biometrics 30 days after. Just got an RFE for the EAD today--I placed an a6 code instead of c9 as the basis for the EAD eligibility. From another forum I am told this is fairly common. And I am thinking the 3 month clock will get reset now 🤔😡

Yes I raised a SR online, but it shows from " the case is currently not assigned for processing"directly jump to "card is being produced".

Thank you! And your explanation was crystal clear! We haven't heard anything about our EAD application so we've been worried. We were lucky to have had the interview scheduled but would still be grateful to receive an EAD just in case the decision takes longer after the interview. But yes, a PR card basically authorizes you to work so the EAD wouldn't be needed. Again, thank you! And good luck with your upcoming interview!

From what I've read on the USCIS website, your clock or timeline resets if you receive a request for "initial evidence". For request for (just) evidence, your clock only pauses while they check the evidence they requested and resumes once they confirm whatever it is they asked about. Hope this helps.

Hi Jass, your i-765 timeline seems to be approaching with mine, if there is no RFE, no faults on your forms, it should be fine, maybe just wait for another 3 or 4 business days! Good luck!

Yeah. Just make sure to call USCIS after 90 days have passed since NOA1 for your EAD. As long as you didn't get your RFE then they'll be able to expedite it. Waiting for Monday then i'll call them.

Sorry for the later reply! So this was my own checklist from the checklist that USCIS sent me. You can always add anything if you have more evidences to prove that your marriage is genuine. I adjusted from K1 visa and had my interview last August 28.

 

•Interview notice
• Passport (Applicant)
• Passport (Petitioner)
•DS 3025 (Vaccination Worksheet)
• I-864 Affidavit of Support
• Form 1040(ITR) for 3 recent tax years
• W2 for 3 recent tax years
• Paystubs
• Birth Certificate (Applicant)
• Birth Certificate (Petitioner)
• Marriage Certificate
• Alien documentation such as:
- K1 visa copy
- I-94
- NOA2 copy (approval notice of I-129F)
- Passport copy (just incase)
• Relationship proofs such as:
- Mails (married name and new address in it)
- greeting cards from friends and family
- Wedding pictures
- Pictures with family and friends
- Latest pictures

- Joint bank accounts or documents (we didn't have one so I just brought more pictures)

- EAD & AP (if you received one)
