Yes, if everything goes according to what you want. Just getting the i130 approved takes arond 6-8 months and than NVC close to 3-4 months.

You could but your i130 can raise red flag to the officer. Don't hide anything from the immigration officer because that can lead to more problems for your i130. The best thing for you is to apply i130 and wait for it's approval, it will save you a lot of headache.

Hi, also you can check out March cases currently waiting approval.  You can sort by column d. That's their USCIS priority date..

Status Spread Sheet -  2017

 

The priority date is the day your processing time starts at the USCIS. For example, my priority date was 8/31/2016.. I'm now at the NVC (national visa center).. They're saying 11 weeks to process, then another 6-8 weeks to get an interview.. My NVC scan date (day I submitted a complete file 4/26/2017) If i add 11 + 8. 19 weeks from 4/26 is Sept 6, 2017...  So a bit over a year.. But i quickly got my stuff to the NVC.. I prepared everything and was on top of my file to make sure it got there quickly. Normally, after the interview, if approved, you get your visa within 10 days I believe... 

 

Regarding visiting.. I don't see why you can't visit while you're processing your i-130..  I'm living abroad with my spouse but if i remember correctly, I've read others who have traveled to temporarily to the US while awaiting their visa..

I found myself in the same situation as your wife and did not know how long or what the process entailed. I did some research and we decided to wait to marry because K1s were taking a shorter amount of time. A lot of people on here told me in October/November there was no way my now husband would make it to May delivery of our baby because every option would take longer than 7-8 months. I decided to be optimistic. We gathered everything we needed filed paperwork in late December and everything moved fast. He did his interview in mid-March so that I could be there but we could have done it sooner. He was approved on that day and we decided in order for him to wrap things up he would enter USA in early April. He arrived one month before our baby was born. I know you will be filing for a different type of visa but my advice is to file everything right away. Get what you need done and request expedite if necessary. Stay positive! I wish you the best of luck.

OP has not explained his wife's medical issues, obviously she has recently travelled,  not that he has to so, no idea if an expedite is even possible.

 

Not sure what the recent fastest processing for Pakistan is, but highly doubt it is anything this quick so would be setting records.

 

I agree that the sooner she files the better.

There is nothing written in stone when it comes to visas and each case (no matter the country) can have a different outcome. I feel for you and your wife and the pressure you are both under, however your best best will be holding on and focusing on the things you have control over. Your paperwork!

 

Please read everything you can about the process and what will be needed of you both, now and in the future. From your birth certificate to (both of) your financial documents, to your documents showing face time (boarding passes, passport stamps). 

 

It took me nearly 3 months to compile a very concise CR-1 packet, which we had to front load due to our red flags. I remember the last 3 weeks before I sent our application in, it felt like all I did was --> print, shred, re-print, check, double check, create cover letters, print and so on...

 

Take your time to learn about what is needed, collect it and once you both agree, have your sweetheart file your paperwork.

 

Prior to filing, you can help her look things over so that the signature files are not missed etc. -- if you can coast through the USCIS stage without an RFE (Request for Evidence), it can save you 1-2 months at times. However if it happens (USCIS might ask for clarification and request additional documents), try not to stress out about it -- once the documents are submitted, they seem to pick things back up (as it happened to us).

 

There is no magic number for any of us, but some of us are facing more challenges. All we can do is to be prepared and practice a lot of patience. 

 

Keep us posted on your progress and when you guys start moving ahead, please fill in your timeline! :thumbs:

This will show you the trends of the processing times per service center (Step 2 in the link).  You'll notice, the TSC (Texas service center) is currently processing the i-130's in 137 days (4.57 months).. But the  CSC (California service center) is currently processing the i-130's in 251 days (8.36 months)...

Currently taking 138 days to process (4.6 months)

 

Then get your interview. (Step 4:)in the link

34 days. 

 

Total processing time (average of all processing centers)

354 days.. 

 

Best case scenario for those who got processed through the TSC processing center..  

 

Processing incoming mail/assigning case number. 8 days 

TSC 137 days

NVC 138 days

To get visa 34 days

Total 317 days 10.56 months.. 

 

-- of course all this could change depending on the amount of applicants they receive.. for Example, when i applied back in August, we ended up in the NSC, they were saying 5 months processing time.. but it ended up being 7 months.. (this is shown on the graph). Must have been a huge increase in applicants..

I have been waiting for a very long time for my relative to get an immigrant visa. Now there is a family emergency and I need my relative to immigrate soon to the U.S. Can NVC help me?

If a visa is available for your relative’s category, and their case involves a life or death medical emergency, processing of your case may be expedited. To request a review for expedite, please submit a letter (or statement) to the NVC from a physician (or medical facility). The letter must include the physician’s (or medical facility’s) contact information, and declare a life or death medical emergency exists. This documentation may be in the form of a scanned attachment to an e-mail.

If a visa is not available, unfortunately there is nothing that the NVC can do to expedite the petition. Immigrant visa processing is governed by the Immigration and Nationality Act of 1952, as amended, which controls availability of visas. There is no provision within the law that would allow the Department of State to issue a visa to someone for whom a visa is unavailable.

You  can visit on tourist visa during 130 process. Baby is not a good reason to get a tourist visa- might be actually considered as a tie to USA which is not a good thing when it comes to tourist visas. 

You cannot apply for aos when you enter on the tourist visa and have an obvious intent to stay and adjust. It's a visa fraud.
