Hi All,

  

I am new here and this is my first post and is out of a very major concern. I hope you seasoned people will be able to help me out here. 

 

Me and my wife got married in december of 2016 and we got pregnant in 2017. My wife and I are expecting our first baby in october of 2017. My wife wants to apply for me as she is in USA right now and is looking for speedy ways as she feels lonely and depressed without me with pregnancy. 

 

Could anyone guide what would be the fastest route for us ?  Moreover, is there anything that we could to speed up our case?

 

Given the immigrant is from Paksitan, would there be any delays or would it take longer to get approved ?

 

My wife feels lonely and depressed and that might affect my kid's health too. Please, help me here.

Concerning extra delays due to country of origin: it is possible. Certain nationalities and people of certain professions can be subject to extra background checks known as Administrative Processing. I've seen a few folks from Pakistan on VJ who were subject to this, but the time hugely varies depending on each person/case. For some, it might be weeks or months, and worst case scenario it could even take longer than a year.

 

Unfortunately I don't know how or why or for what reasons people are targeted apart from nationality and profession, so it's impossible to say if it will end up causing extra delays. It's just a possible risk I would say.

 

If she's really lonely she might consider temporarily moving to be with you. Unfortunately that might just be the best bet given the waiting time for a CR-1/IR-1. :unsure: And sadly, USCIS does not view pregnancy/childbirth as a reason to speed up a case.

She has to maintain her domicile in the USA if she's the person who will start the immigration process and be the sponsor of the case.

They do not.  Not until entry.  Many people file for I-130 from abroad and move home with their spouse.  Things like drivers licence, an address (can be family nothing against that) voter registration etc

So then I suggest that she moves to Pakistan to give a birth. I doubt that the case will be expedited that much considering the OP's country (which is under AP).

she cant travel now. I work for a fintech here in Pakistan and my company is registered in USA. i dont think i'll be subjected to AP. no ?

She cant travel now. she is a citizen :(  i hope it doesnt take longer than that. i heard that it can get processed in 6 months as well

6 months is only for the first stage that is USCIS. Add another 4-5 months for the NVC stage and consulate processing.

I don't know all the ins and outs of AP but you might move through it very quickly. It's way down the road in your process anyway so I wouldn't worry about it too much for now.

I'm not sure about it being processed within 6 months. Where did you hear that? Usually just for the I-130 alone it takes 4-5 months. You need to plan for a year minimum. This is unfortunately just how it is.

We're all in the same boat and you unfortunately can't dictate them if it's too long or not. Regardless of the fee, it's their rules and you can either accept them or not. To tell more, it might be longer if USCIS and/or NVC is overloaded later this year.
