Usually when they say that the petition it's sent back to nvc it's a diplomatic way to say it's refused . Can you give us some details of your case such as is there any big age difference or such thing that could had been a red flag for them sometimes also they send the petition back because they didn't believe the relationship was real .

me 35 my gf40...my interview is good...we are both are same country meet fb and meet 2 time...interview fenish co took my passport and say we didn't tack any decision now ...we sand u mail...

Have the petitioner contact he embassy or nvc and she has to ask them why exactly did they send the application back . You guys might have to seek the help of a lawyer to advice you on what to do next but maybe what will work better for you is to get married and have her sponsor you as a husband . Certain countries seem to be more strict than other to provide k1 visa specially when the male is the benificery .

Until you and your gf can determine exactly why the CO sent the petition back, there isn't anything you can do.  Once you get that information, you can work on the problem areas and move forward.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

If they wont answer your fiance's email inquiry for reason of refusal then have your fiance contact her senator and ask him to

do the inquiry.

Once the case is returned it will be purposely expired by USCIS and K1's are not reviewed.
Your options are to either refile a K1 or marry and file a CR1, which would get reviewed if it were to be returned.

No lawyer is needed.
Refusal / returns of petitions for a K1 usually happen due to 'lack of bona fide relationship' findings by the CO.
Spend more time together visiting and front load the next petition with plenty of relationship evidence.

July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Before you get married and start the CR-1 one, you need to know what the reason behind the refusal was and make sure to overcome it.

As I said she needs to contact her senator to get the reason of refusal if they don't answer her email inquiry.

They will send you and your GF a letter in the mail. 9 times out of 10 it will stated that did not have enough proof of relationship. I just went through the K1 process with my now wife. I had seen on the US Embassy Dhaka Facebook page the consul general was answering questions and said that due to a cultural context thing it is extremely  difficult to get K 1 visa in Dhaka. It was on the chat from March 15th.

My case I thought was very strong many trips she came to see me and a few trips we took other places as a family. My son's birth certificate,  all travel documents  flights itineraries and boarding passes, lots of pics, many emails and chat logs, and screenshots. We even sent in receipts  from some of the trips of things we did. I brung additional information at interview but still denied.  So a few months after that me and my wife married. We filed for the cr 1 and added even more information to this petition.  We know the wait will be long so we are planning another trip as we both love to travel and try new food. So by the time our next interview come will have more time together as a family and more pics. 

 

By the it took over a month to recieve the paper from embassy after they denied me.
