I have read strories of Filipinas working/residing abroad, granted divorce abroad and filed K1 abroad. I am not sure if this is applicable in my case as I am now in the Philippines and applying here. Also with regards to CFO thing I dnt know if they will issue a CFO sticker for someone like myself who acquired Foreign Divorce abroad. 

1.) You can't apply for a K1 unless you are a US Citizen

Just when you think you have TDS eradicate,  a new case shows up.

The US Embassy in Manila follows US immigration law, same as US embassies in other countries.  At the K1 visa interview, USEM will accept a foreign divorce decree as valid Proof of Termination of Marriage.

 

As for CFO, bring a copy of your divorce decree and see how it goes.

USEM will ask for a CENOMAR. You will provide them with the CEMAR showing your past marriage + the final divorce decree, showing the termination of the marriage.

No issue....many, many people have done this fine.

Nobody's encountered the same case as yours as every case is unique. But the relevant facts and circumstances with regard to the foreign divorce and a K-1 is not uncommon.

Many thanks! Just wondering how true that aside from getting the Cemar attached with Foreign Divorce Decree one should also have the MC annotated by NSO(now PSA) and bring during the K1 interview in Manila.

First off, PSA do not annotate MC unless I file a Petition for Foreign Divorce Recognition. 

Thought I dnt need to go through the recognition route as Decree Absolute is good to go for K1 visa even when Cemar states still married in Phil. 🤔

No need for any annotations. That's if you want the foreign divorce recognized within the Philippines. It's not needed for US immigration. They recognize the divorce fine already.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
