90 days passed, no EAD - what can I do?

I filed my I130, I485 and I765 plus all the rest on March 3rd

Had RFE that I sent back and was received Apr 7th

Had biometric appointment Apr 11

 

Now my current EAD is about to expire and with it my driving license.

Should I be worried? I have not seen any change since the biometric. Should I have gotten anything else?

Anything I can do?

 

Any idea about renewing my driving license in CA with no official status?

Call USCIS and put in a service request for your EAD. As for your license, if you carry your I-797 and your current license (and whatever additional docs you need to renew), they will extend your driver's license. I had to do the same thing.

Will they renew even if my EAD was not yet approved? 

I found that in their website:

• Notice of Action (I-797 Approved Petition) - must indicate approved extension of stay or change in status that grants temporary or permanent residency, or indicates that an original, duplicate or renewal Resident Alien card is forthcoming.

But it says you need to have the doc to show they are approving the request

I'm not sure what that is saying but I was able to renew my license with the NOA1. I would argue that the acceptance of the application by USCIS does indicate a temporary approval of stay (for as long as it takes USCIS to approve or deny your AOS).

I got my license!

I think she got confused. She originally said no and explained that a NOA only works if it notifies the approval of the request, not just that they got it.

Later, she went to check again and than came back, said I get 180 days automatically for my EAD so they can do the same forthe license. Now, I think that does not work in my case (F-1 OPT to GC) but she was trying to help and I wanted a license so that was it for today.

Got my temp license, expires in 180 days.

Tomorrow I'll start calling USCIS to check on my EAD

Yes, definitely does not apply to us F1 to GC people! That threw me off too when I got the NOA. Congrats on a successful step in this excruciating process.

Hi everyone,

 

Where in CA did you renew your license? Mine expires today and like you, I only have NOA1, from forms I-130, I-485 and I-765. On the DMV's website it says that only an EAD card is enough proof of legal status but I don't have this yet since we filed on May 11, 2017. I had a J1 visa before, that's how I got my driver's license in the first place,

Should I just take a chance and go to the DMV? I called just now and they said the same thing you found on the website, that the receipt stating they got my documents isn't enough. Did you make an appointment before going?

No, I did not have an EAD, I only sent that document with my package of AOS in May.

I was working the 20 hrs allowed with J1 and then received an extension through academic training, it expires this Friday 6/16/17

How could you have worked with no EAD?

 

I'm asking because what helped me was that they got confused and thought I can get a 180 days extension on my EAD. If you never had one to begin with I find it hard to believe they will give you a new license.

If you work at the institution that gives you a visa (DS-2019/ I-20) you are allowed to work up to 20 hrs. It's sort of included I guess. I've had F-1 in the past before and that was also the case.

 

I do still have a valid foreign license but that is not good after you've been here a while, CA license is required.
