Hi Everyone,

 

I need some advice, I have read through a few posts in regards to individuals concurrently filing and I just wanted some clarification not sure if I am understanding correctly. 

On the I 130 form it asks whether the beneficiary will apply for adjustment of status. My husband is currently in the US on a B2 visa and I am wondering if we need to file the I130 form, wait for an approval then send in the AOS package or should we do them all together? 

 

The reason we are filing is that we just had the birth of our son and with only 6 weeks to go back to work the best decision for our family would be to have dad (my husband) stay at home with our son for a few months until we can establish other plans. 

Also do we need to do this through a lawyer or are we able to do this on our own?

File them all together, and you can do it by your self lawyers are expensive, me too came on B2 visa and did it our selves with my husband's family. And i recieved my EAD/Ap on 18may 2017, filed on 14feb 2017 ,,,, goodluck !

No, that's not possible. 

 

Those who enter on K visas and a few other categories have a chance at an interview waiver, but not a tourist who entered on a B-2; they will always have an interview.

I was mostly relieved that it didn't take too long! But mny of the couples with interview (November filers) got their appointments not long after our approval - had we gotten an interview though, I think we would have been waiting quite a while since Dallas has long waiting times! I think probably that's a reason why mny Dallas K1's are waived the interview too - to lighten the workload, but that's just my own speculation :)

K1's have an interview at the consulate so that's the reason why mny are waived at the aos stage.
