Not sure if it has been mentioned before but if there's something wrong with the i-864 or its supporting documents then they automatically say that the person in question doesn't meet the poverty limit. It's a generic response and doesn't have to mean that it's actually true. You could for instance have a sponsor that earns $70,000 a year, a two person household, and yet get the letter about not meeting the required poverty limit just because there's something else that is wrong. Could be missing tax returns, wrong household size on the form etc..

Absolutely, and when the wrong is with the affidavit of support they list what is wrong and that they didn't meet the poverty limit, even though they did (not sure if they did in this case though, haven't read the thread). The not meeting the poverty limit seems to be a generic thing on those lists/letters.

if they are missing tax returns, the checklist says "missing 20XX tax return" or "household count does not match"  It doesn't automatically say "does not meet poverty guidelines."  HOWEVER if you are using assets vs income only, it often will say "does not meet" even if you do because you don't meet the "income" level.

It does automatically say that in most cases I have seen on here actually and it makes people very confused. People forgot to send tax returns or had the wrong household size on the form etc, and that was listed of course, together with "does not meet poverty limit", even though they made waaaay over the poverty limit.

 

Maybe my English isn't good enough and I just misunderstand what you're trying to say?

Exactly.  Actually EVERY time assets are used to qualify, whether in part or all assets, you will get a notice indicating it does not appear that the sponsor meets the income requirement (because they don't) no matter how much in liquid assets are stated and documented, but that they are sending the affidavit to the Consulate where the Consular Officer will make the decision.  This often confuses people but it is really meaningless, if you know the assets were sufficient to qualify.

Facts are cheap...knowing how to use them is precious...

Im going to guess that people are including assets when they arent needing to.  If you do not have a joint sponsor, and make more than enough income, use the I-864ez.

If your income is all W2 employee income, yes.

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
