Affidavit of support not asked for at interview

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

The Embassy does not require an affidavit of support and hasn't for more than a year BUT they still leave open the option that you submit one at the interview. (See paragraph below and link) If you don't have it at the interview you will receive a 221g causing further delays. This is contained in the Embassy letter. Note the it states "may be useful" but falls short of it to be a requirement. So one should prepare the affidavit for their interview to avoid a 221g.

 

EVIDENCE OF SUPPORT.  You should be able  to  demonstrate  that  you will  not  become a  public charge  or burden  on the U.S.  taxpayers for  financial  support. A  completed I-134 Affidavit  of  Support  Form  may  be useful  to the consular  officer  to  evaluate your  petitioner’s ability  to be financially  responsible  for  you. You may  also  be asked to submit  your  petitioner’s most  recent  U.S. Federal  income tax  return  (Form  1040)  and wage statements (Form  W-2). Employment  letters  stating  salaries  and bank  statements may  be included to substantiate the I-134. Download Form  I-134 at http://www.uscis.gov/portal/site/uscis.

I've read all that stuff before. My fiance had everything at the interview they just didn't ask for it. 

 

So basically it's up to the interviewer? My fiance had it from me they just never asked for it. They didn't ask for any financial documents at all.

Embassy change their instructions letter back in 2014, change the requirement for the support evidence to "we may ask for.." , majority of the time they don't ask, but it is best to be prepared - as the "may" ask for it.  ;)

We shouldn't have any issues though? They didn't ask, she had it, but obviously it's not her fault they didn't ask for it. It's just concerning they didn't ask for a single financial document. I was in the Philippines for almost 6 months though, so maybe they just assumed I'm good financially?

Nope you won't have any issues.  Believe it or not, most return from their interviews still carrying the support evidence with the K-1 visa, like said the rules changed back in 2014.  I suggest for people to be prepared, as they do ask from time to time "just to keep everyone honest" :lol: 

 

6 months.  That is how long we are planning to be in the Phils this trip.

6 months.  That is how long we are planning to be in the Phils this trip. 

That's ridiculous! I spent a hundred bucks to send her those documents lol. Oh well at least she had them.

I spend over $1000 do get those documents to my wife for the interview... of course I hand delivered them  :lol:    Then we hung out for two months after the interview before flying home.

Yes its up to the CO/interviewer what they will require from you. Not being asked for it but having it would have saved you time if asked. Nothing here to worry about. If they didn't give her her passport back then chances are she passed.

Well they told her she was approved and kept the passport. I was just concerned since the affidavit of support is usually required. Philippines is always surprising me. ☺️

Ohhhhh?  You don't know the half of it.  I been here 3 years and Hank has been here much longer, we been helping out folks like you and we will never be able to say "we have seen it all". Even when you search for case status, you have to know when you are an immigrant and when you are a non-immigrant or you will never get the information you seek.  We recommend a cold beer and patience to get through this journey.  

 

My wife, after 1 year 4 months finally received her 10 year GC.  We processed through Vermont but the California people's process was right at 6 months. So don't be surprised about anything and expect the worse.
