travel while waiting for ROC to complete

Wow this site has changed alot and  hope this gets to the right forum. 

 

My GC expires end of Sept and I know that I need to do ROC within 90days of the expiration date. 

 

Can someone confirm for me  that the GC is valid up to that last day and I should be able to back into the US after spending a week in CAnada?  

 

I did ask a US Customs officer at Pearson early Jan and he said GC is valid up to the last day from his understanding.

The GC has an expiry date on it. Its good until that date.

 

Ideally you start the ROC process near the beginning of the 90 day window. Hopefully then you will have the NOA1 for that well before GC expires. As I understand it the NOA1 essentially extends your legal presence date for 1 year, so can be used in combination with the expired GC until you have the new one.

 

My GC expires in November, so I'm in a similar situation. In North Carolina, as with quite a few states my drivers license is only ever issued up to the end of my legal presence, so it expires when my GC does. I'll have to use the NOA1 to get a new one at that point.

The moment you receive your NOA1 for your ROC, your conditional green card is automatically extended a year — just simply present your GC AND NOA1 to the officer at customs and you'll be granted entry.

H Limey , thanks for replying . Same here in California - driver's license is expires same date as the GC. 

I read that you have to submit on the exact 90th day prior or less  of the expired date or it will be rejected . 

 

HI Zilchfox, thanks for replying.  Well I hope I get that NOA1 fairly soon after submitting the i751 form if I must have that as well for re-entry. 

I am planning on travelling back to Canada Aug4-14 and planning to start ROC process end of Jun.  Guess I will buy flight insurance just in case :-)

Yes. 23:59 on the date of expiry.

if the card hasn't expired, not neccessary.

You don't, if the card is still valid.

I would be very surprised if you don't have the letter in hand six weeks after submitting - normally one or two max.

Worst case and it hasn't arrived, before you leave, take your proof of travel and go get an I-551 stamp which acts instead of the expired card & letter combo.
