How long to wait for Advance Parole?

Timeline

We're right at the beginning of the K1 process but I have a question for further down the road which I haven't been able to find an answer for elsewhere on the site.

Does anyone know roughly how long it takes to get Advance Parole?

It's my understanding that you can apply for Advance Parole once you are married and you have filed for AOS? Not that it is my desire to get to the US and then quickly leave again, but I just won a court case against my ex-partner which allows me to take my son with me when I relocate to the US. The conditions are that I bring him back to the UK twice a year for visitations with his father. As I am court ordered to do this then I need to be able to know roughly when I will be able to leave again....after...erm..arriving..

(sigh)

also...I have read that leaving the US on advance parole can be problematic...(people having difficulty being let back into the US etc) as soon as I have a court order that states I have to return with my son to the UK twice a year...will that make things a little easier for me? I wouldn't even need advance parole if it wasn't for the court order.

AP can take up to 90 days or more to get.

In cases of emergency, a person can schedule an info-pass appointment at the local USCIS office, and get one, but evidence of the emergency needs to be provided.

I heard that it takes about 3 months to obtain after filing, and that most people do not have problems re-entering on it. Some advise I read here on VJ was to have your NOA1 with you, and a certified marriage certificate, just in case they want some additional info.

:thumbs: just wanted to add in addition to the evidence of emergency, you will need to show the NOA1 for the AOS.

We filed for the Advance Parole in the same package with our AOS and EAD application.

24 March 2009 I-751 received by USCIS

27 March 2009 Check Cashed

30 March 2009 NOA received

8 April 2009 Biometric notice arrived by mail

24 April 2009 Biometrics scheduled

26 April 2009 Touched

...once again waiting

1 September 2009 (just over 5 months) Approved and card production ordered.

thanks guys for the quick replies.... that's very helpful!

whether or not the 3 month wait is a problem I guess will depend on the timing of our arrival in the US.

I am supposed to bring my son back for the first visit at Xmas...it's good to know there are ways to speed up the process though if need be.

It's also good to know that travelling on Advance Parole isn't too much of a problem for most people...I guess you read a few horror stories and they tend to stick with you... thanks Nanusia & Lukaszek for the reassurance

Yes it takes about three months.

My recommendations:

Get Married immediately legally after entering

Request a copy of the marriage cert and file AOS ASAP

File for AP concurrently

Enter into an agreement with the ex that states that this trip is dependent upon approval of the USCIS approval of advanced parole.

With an April filing, you're looking at a possible October approval.... Your ability to apply for AP is dependent upon when you marry. You can see our timeline in my signature.

You can get an infopass appt to apply for emergency AP, but you may need to prove an emergency. Not sure this would classify.....
