Hello VJ's, I received my K1 visa 2 weeks ago. I want to get married and adjust status as soon as I arrive to the U.S. But me and my Fiancé are wondering how much time does it take for me to obtain the green card after we file AOS with USCIS and If it is possible for me to work while AOS is pending with USCIS. Some people say its possible to obtain a social security number and work permit in about 2 weeks of arrival to the U.S on a K1 visa. Any guides would be grately appreciated.

You can get the SSN pretty much as soon as you want after you land - just go to the SSO and apply, you can pre-fill out and print the ss-5 application form from their website and you'll need your i-94 (download from i-94 website after arriving) and your foreign passport. It can take a couple of weeks for you to get the card if you are verified right away, but if you'll need further verification it might take longer (which is also why it's good to apply ASAP)

 

You can't get a work-permit right away - you will apply for the EAD (employment authorization document, i-765 - for working during aos processing) and the advanced parole (i-131, for international travel during aos processing) together with the aos (i-485), and they are free of charge when submitted together with the i-485 - complete package cost $1,225. It takes roughly 3-4 months currently to receive the EAD/AP combo card. The aos itself can take anywhere from 3 months up to over a year. It will depend on if you get 1. direct approval from the NBC (national benefits center where all three applications are redirected from the chicago lockbox at first and processing time will depend on NBC but normally 3-5 months), 2. approval after interview at local office (where it will be re-directed if you will have an interview, processing times will depend on local office but normally between 4-12 months) or 3. waived interview at local office (you will receive a letter from the local office of interview waiver - normally takes up towards 10-12 months, but also depends a bit on office).

You should definately go obtain a SSN. This is recommended before marriage honestly.

 

Once you file, generally can take 2-3 weeks for the NOA's for the AOS packet.

 

We just received our combo card for EAD/AP and it took right at about 90 days. Then you can work once you have the EAD.

 

We also just got notice that we are "Ready to be scheduled for interview" for th I-485, this is also about 90 days for us; but again we don't expect to hear much else for a bit still regarding that as the green card itself can take 10-12 months, sometimes a bit more to physically receive.

02/03/2017 - Married

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview
