Homosexual Malaysian man looking to marry my boyfriend

I'm a legally Muslim (actually atheistic) Malaysian male looking to get a visa to travel to the United States to marry my boyfriend and become a permanent resident. However i'm a little wary to start the process here in Malaysia due to a few reasons.

Sodomy is illegal here in Malaysia and Homosexuality in general is illegal for Muslims according to the Islamic Courts. Being "Muslim" myself, I'm worried about being ousted and prosecuted here in Malaysia if we were to go with a fiance visa and set it up here. Ethnic Malays are not allowed to convert out of Islam in Malaysia therefore conversion is not an option for me to take to ensure i'd be safe enough to go through with the process and such. Can anyone maybe alleviate my worries or recommend what I should do in my situation? Feel free to ask questions.

I would recommend your boyfriend see a lawyer and explain your situation since it's quite a gray area. You cannot travel to the US with intentions to marry without the correct visa, and it's illegal to lie to a border officer.

It seems to me that you have 2 options: (1) K-1 Visa (enter US after processing) or (2) Marry in a 3rd country (enter US after processing of CR-1 visa).

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

The thing about the K1 visa is that you're required to provide a Police Certificate and seeing as i'm trying to marry a man, I'm anxious about having to ask for one with the situation i'm in.

You would also need one with a CR-1 visa...but do you have to declare that much detail to the authorities when applying for the PCC?

How much information would I have to divulge to the police to get the certificate? I'm just really scared about doing one wrong thing and ending up in prison or worse

Yes.  He certainly can't marry in Malaysia.  But he will still have to obtain a Good Conduct Certificate from his home country if he ever wants to get a K-1 or CR-1.  I think he should download the GCC application form from the Malaysia web site and see exactly what information about the purpose he must provide to the authorities.

you could simply state a relative is petitioning for you and you need a police certificate for that. there is no need to give them more details than that. if pressed for a name have one ready only the us embassy needs to know the real name and relationship between you and the petitioner.

As above, you don't have to tell them anything about what it is for except perhaps say obtaining a family visa. 

 

As to dealing with the US Embassy, that is different as for them same sex is fine as it is legal and same sex marriage is legal in the US.

 

Again as for your dealings in Malaysia with other Malaysians, in general, you don't need to divulge too much information honestly.

my boyfriend is from Malaysia but lives and is doing the process in Singapore, he got his Malaysia police report without having to disclose why he needed it....... I don't think that part of it should be so difficult, you frequently need those for employment.... but the K1 visa is how you have to go and your boyfriend has to start that process for you, you will be interview by American immigration officer who will not be a problem for a same sex couple, you will just have to push thru your fear .....if you want to marry your partner, my boyfriend was concerned as they have those laws in Singapore as well...... but your interview will be in the city and if it is possible he should join you for the interview, I am the citizen and plan of being there for my fiance to help ease his fears and anxiety, I have also learned on here that it goes a very long way in helping your process go thru more smoothly as it show in real time a real relationship

03/14/17 - NOA1 Text and Email. Case to California office
03/16/17 - NOA1 Hard Copy Received
xx/xx/17- NOA2 Text and Email Never came 
06/26/17 - NOA2 Hard Copy Received and it is still has no message on the USCIS site
07/1817 - NVC Received I-129F 
07/19/17 - Case Number Received I called 3x and it had been
07/21/17 - Embassy Received. Case status set as Ready
07/24/17 - Received NVC letter hard copy from NVC

07/26/17   Embassy sends Packet 3 registered mail

07/27/17   Returned Package 3 to Embassy

08/15/17   I fly to Singapore to see him and be at the consulate with him for interview

8/23/17     Adminstrative processing for an original receipt for the DS 160 payment

9/13/17      Admin Processing for name change, name was out of order Asian name put in American order and it was wrong on I 134

                     also need a Police Clearance from Australia,  he went to school there in 2008 need to prove was not there more than 12 months                           could not prove as it was 3 passports ago... so delay to get police clearance

11/6/17       Status updated to ISSUED

Yes, it is illegal for you to do that according to Islamic law and same sex marriage is not allowed here in Malaysia. However, same sex marriage is legal at States. So, you don't have worry about that. Regarding the police certificate, you can simply apply it online. If let say the police asking you what you want to do with that, simply said that you are applying for K-1 Visa, no need to offer more information to them. My advise, don't let others know about your intention to have same sex marriage except the consulate officer. Because, if you tell the wrong person, they can simply report you to the Islamic department and of course you know what will happened after that right? Good luck to both of you! :D
